Very true, but I would still prefer to phrase it as a question.  Always let the officer think they are in control of the situation, for your safety.


A better phrasing may be, "Am I free to leave?" IIRC, that's the expression used in the Supreme Court opinions regarding roadside searches, and it's neutral.
