I don't support firing teachers for having a private life, but what's good for the goose is good for the gander. You are absolutely correct - administrators should be held to an even higher standard than teachers.

Besides, this administrator is clearly a bully and an imbecile who doesn't understand student rights.

It depends on how it was phrased: Here's a mugshot of the principal after getting arrested for a DUI vs. Here's a mugshot of the principal, I think she'd been arrested for DUI.  One is likely libel, one is just stating an opinion.

In general the police shouldn't release mugshots at all unless there is an overriding reason.  When it's done to shame' people that's an issue because it's not the cops job to met out punishment, that's the judges job.

Then change the law.  Booking photos, just like everything else the public safety field does, is subject to public scrutiny.  You can walk into your local police department and ask to see their policy manual, and by law, they're required to show you.  If not, you can fill out a FOIA request and they'll be compelled to show you.

It's no different with booking photos.  They're public record.  Very rarely do the police release them with press releases.  90% of the time they're released due to a FOIA request by a news agency.

You can't fault them for complying with the law.

Though some Farkers will.



FOIA = Only applies to Federal government.

Public records laws are passed at the state level, and vary from state to state.

I love it when idiots spew on like they know the law.  You don't.

I really love how this backfired on her.  Thousands upon thousands of people know about her arrest now and have seen her mugshot.  I'm surprised she didn't think her cunning plan through before suspending him.  She's clearly not the sharpest knife in the drawer... what a shame she's an educator.

One is usually voluntary, the other is usually not. Also, unless the arrest itself is somehow against school policy (for instance, if she'd had a felony conviction that she did not report before hiring and they specifically asked about such), then no; her criminal record would already have been known by the school system.


having someone snap a bikini pic while on summer vacation and having someone publish it against your will isn't really "voluntary"

Meh. I was 100% in the student's camp until this:

Varner chose to add that he thought she'd been arrested for a DUI. This turned out not to have been the case.

Could have been libel if he'd worded his suspicions poorly, but at the very least he's initiating unfounded rumors. I can see why people might be pissed at him.

The police are VERY fallible. They are not only not good at catching people, but they're very good at inflating charges. So when they drag you in for a mugshot, chances are you're probably not guilty of what you're there for, and so it should be illegal to have such a photo or display it publicly.

nothing personal, but a society which arrests you for that needs to be burned to the ground and start all over.
