Montana is the only state where I've seen people drive home with drinks in their hands.

I know it's not the only state where this takes place, though.

It may or may not be "driving" under the influence, but for all intents and purposes, yes.


Depends if that statute specifically requires "operating a motor vehicle" while intoxicated. If not, they can always get you for cruelty to animals--and if you fail to pull over for the cops, fleeing to elude is a worse crime than DUI in most states.

Depends on your State's law.  Kentucky  defines "vehicle" as including "All agencies for the transportation of persons or property over or upon the public highways of the Commonwealth...."
