In most states an engagement ring is not a gift - it is a token of a promise to get married.  When one person backs out of that promise (in these states) the ring is legally supposed to be returned.

Giving the ring in conjunction with a holiday (Christmas for example) muddies the water allowing for the woman to claim that it was, in fact, a gift.

Having said that - our baseball team is one of the hottest teams in the league right now.  Our football team owner is being investigated by the Feds and the IRS.  Our basketball team is in shambles but has several high draft picks coming up.   And an international news story about three women held captive for a decade broke 48 hours earlier in this same town....

So what does the local "sports talk" radio station argue about for 3 hours yesterday?  Yep, this.

Whatever.  We all know damn well that an engagement ring is not a gift.  No one says "I don't want to get married, but here's a random engagement ring I thought you might like to wear when you go out clubbing.  It's a gift, enjoy!"

This- it creates a contract, and if the contract isn't fulfilled, the ring goes back to the party who gave it.

I thought if the man backs out of the wedding the woman can keep the ring and if the woman backs out she has to return it. I know this can vary from state to state IIRC. There was a fark thread about it

An agreement to wed is a unilateral contract with an engagement ring as consideration.  As long as the woman keeps her end of the deal (by her willingness to get married), she gets to keep the ring.

State law governs it. Given that one party might want to end the engagement because of misbehavior of the other party, the system you propose seems problematic.
