Putting a 13 year old to death doesn't seem right, no matter what the crime.  Granted, 2 years probation seems light (the headline says two months, the article says two years).

This seems like a case where commitment to a mental institution with intensive treatment until such time as the perpetrator is no longer a threat to those around him seems like the best course of action.

I imagine that this will become relevant.  It's the part of the ADA that says that if a kid rapes another kid, as long as their "disability" made them do it, they can NOT be removed from their school for more than 45 days.

If your "normal" kid commits the same rape, expelled permanently.

"The only exception to this practice is governed by Federal law. This exception is in reference to students with disabilities, and applies in cases where his/her disabilities have been determined to play a role in their actions. Federal law prohibits school districts from placing students with disabilities in an Alternative Education Placement for more than 45 days. Following the 45 days, the student is then placed on his or her regular campus and other measures are taken to ensure that the student receives appropriate special education services and is adequately supervised in accordance with any applicable court orders.

Seriously... that actually does seem to have more of a penalty.

A 13-year-old goddamned well knows better than to do something like that.  Perhaps not jail, but serious, serious rehabilitation and therapy is in order here.  Anything less is failing both the victim and the perpetrator --  both children -- and society (especially the future victims)

This is a failure all around.

Thats farked up. I wonder if the 13 year old was considered 'disabled' before either of these incidents? Also, he raped the 4 year old twice. Why are they being treated as a single incident?

Don't forget, the legal definition of rape is any penetration with anything. A finger tip for one second is rape. So is an hour long torture session with a mop handle. Same word, myriad possibilities.

Any what kind of school has four year olds AND teenagers? That's a red flag.

And Texas let a man who shot dead another man who was molesting a 5 year old go without prosecution.

My theory is the 13 year is developmentally disabled and not capable of functioning at his age. Texas, being Texas, still prosecuted him while in Europe he'd have been fully pardoned because he can only count to pomme de terre. He's back in school because there's only so many special needs classrooms and Texas is a big state.

That's my guess, anyway.
