Family Friend/Neighbor was taken to court by her ex-husband trying to reduce his child support payments (which he hadn't made in 2 years) because his new pregnant wife, new house and new car were costing him enough, he didn't feel he needed to support his first two sons as well.  She was terrified his non-paying ass was going to be let off the hook for the remaining 12 plus years of child support, which would probably mean getting a third job.  I saw her come home from the hearing, literally dancing in the driveway.  Judge said: "Not only will you write a check for 2 years of missed payments right this very minute, or go to jail, your monthly payment is now doubled and you must pay it through the state child services agency so we'll know when you 'forget' and make sure you remember..."

He was a monumental dick.  When my sister fell off her bike, he ran over from his front yard and declared that she hadn't broken any bones.  She hadn't, but he sent my parents a bill because he was a chiropractor and figured he was acting as a doctor so they should pay.  They ignored the bill and he never pursued it, but that's the kind of dick he was.

wow.  just wow.  How could he have NOT been a chiropractor?

Usually it's a pende lite (sp?) order that becomes permanent with the divorce.

My friend had his business tank with the economy. Shiat happens. Full bankruptcy, everything gone, including the truck (company asset) and he goes to court to get his payments reduced because he's now making $12 an hour at a national company. His ex is screaming about how unfair it is that he wants the payments changed.

Long story short: The payments didn't change. They "imputed" his income to be $100k a year. He is in jail right now. This is a guy without a college education that built a small business up only to have it implode and take all of his net worth with it. On top of all that, he was found in contempt because he couldn't keep up with: child support, alimony, and two life insurance policies (one for the ex, one for the kids)

The real burner of the legal side? He had to pay for her lawyer too, lost his house (tiny as it was), and has little hope in EVER digging out of the CS / Alimony hole he's in jail for.

It's not like this guy was working for a buddy getting cash under the table. He was working for a national company, and filed all the appropriate papers to notify of his new job. He then had his lawyer beg the judge "pretty please, lower my client's payments" while his ex-wife's lawyer (that he paid for) was calling him a deadbeat.

Mind you, when they divorced she got the: House, SUV, brokerage account (the whole thing) the kids (70/30 or some such placement), and alimony.

He got: his business

Two years later and he's pretty much given up now. What's he going to do? Start another business when he's stuck in jail (on and off), can't get a loan, and wouldn't be able to put a penny back in for heaven knows how long because he owes so much back CS & Alimony? He figures he'll be living in the lockup on and off for the next fifteen years at least.
