RTFA. As I read it, she's not suing because the coffee was hot, but instead because Starbucks allegedly gave her defective cup that didn't hold the hot coffee, causing it to leak out and burn her. To quote the article:

The suit says that as Arslanian received the cup, coffee "leaked and flowed from the container on the bare right hand and arm ... causing her to sustain severe burns" and suffer "permanent injury and scarring." The suit describes the injury as "extensive and gross second and third degree burns to her right hand and arm."

Nobody's gonna award her $10 million for that (and the amount of a demand in a complaint is picked out of the air--everyone, including the plaintiff, knows she won't get that), but providing someone with a leaking cup of steaming hot beverage does seem like a legitimate basis for a product liability lawsuit. But despite what the headline says (and despite all the discussion of the McDonald's case in the article), she's apparently not suing because the coffee was hot--she's suing because it allegedly wasn't properly packaged to prevent it from leaking out and burning her.

what i see the majority of people do is: oepn it up, try to taste it, burn their tongue, swear, than put it down for an hour.

I don't think the "farktards" are the problem (and in fact, I don't think the woman in this particular case -- who was burned while receiving the coffee and having it spilled on her -- is a farktard at all) as much as its judges and juries who award the amounts. Just because I bring a suit for $10M doesn't mean I'm going to get $10M. Someone has to say, "You know, Hazel, you're right. Here's your cash and some delicious candy."

I want to know how this person managed to get "second and third degree burns" on her hands. I've managed to spill hot coffee on myself from many places, Starbucks included, and never gotten more than a simple first degree burn. I have to admit though, the burns I sustained from Starbucks were far superior... such a lovely shade of pink that accented the rest of my flesh, unlike those cheap pale colored burns you get from McDonald's coffee.
