Parking lot of a business is not public property and you can be asked to leave at any time for any reason. If you refuse, the business can ask that you be removed by law enforcement.

If a cop (looks to be,) you're disobeying a lawful order (trespassing - refusing to leave.)

If not a cop, same result. If he's acting as an agent/employee of the liquor store, he's asking that you leave - he doesn't need a reason.

The guy offered no proof of who he was including any proof that he was authorized to tell anyone to leave the property.  Still if it had been me I would have left and got the owners info from the local court house or better business bureau.  Showed the owner the video of the asshat not doing his job correctly.  If the owner or manager or whomever didn't see a problem with that I just wouldn't shop there anymore.  The fact that he ignored the drunk dipshiat tells me this guy was just out there being a douche.

He tried to leave.  The video clearly shows him going back to his car and trying to open the door, but the douchebag cop wasn't done swinging his dick around yet.

The cop was working as hired security for a liquor store in the ghetto. He has full authority to tell him to leave and then arrest him when he didn't.

He never properly identified himself.  All he did was escalate.  He only succeeded in making the problem  much worse than it needed to be.

Anybody can say "I'm a police officer" but no reasonable person is to believe the person claiming it unless they back it up with a badge. At no point did I see a badge get produced by the officer.

I saw him flash something for about 2/3rds of a millisecond that may or may not have been a badge, but not until two minutes into the confrontation.

He was correct in not giving the cop the can - that officer would have smelled whatever he wanted, arrested the guy, and conveniently "lost" the can on the way to the station.  Where he farked up was not leaving and coming back later when his friend was there with money.

Yeah, it was all bullshiat, but the only real thing the cop had on him at that point was loitering.  If he left, then he wasn't loitering.

So to recap:  correct to fight about the can, incorrect to fight about leaving.  He wasn't a customer yet.

Let's look at it from the liquor store's perspective.

They're probably in a state of continual defense for previously-allowing loitering, so were forced to hire a guard to shoo away people, or lose their liquor license.  The guard was checking the guy out for appearing to loiter and drinking out of a can.  Soda cans have been known to be filled with intoxicating beverages to trick those in authority (I did it myself all the time in college).  The apparent loiterer wouldn't hand the can over for inspection or smelling, so the situation escalated into an arrest.

Seriously, people, when will the common sense of realizing the situation from the other party's perspective kick in and avoid these stupid complaint videos?


Yeah, I'm sure the liquor store hates customers coming around and trying to buy stuff.

I don't think the cop has the authority to demand to smell the can in the first place.  There may be some info we're not getting but I think that crosses into illegal search territory.  Only when the cop realizes he's not going to be able to huff and puff into getting his way does he start with the trespassing.

That's pretty impressive that you can tell someone's sobriety based on a single picture. Personally, I thought that he just looked pissed off and irritated in the second picture, almost like someone had been harassing him. But I'm not a professional like you seem to be.

Even if he was a cop, he wasn't acting in the capacity of a cop.  He was a private security guard hired to enforce policy on private property.  If Mr. Ice Tea doesn't like it he's free to leave, provided he doesn't cause a problem.  In which case, the police will be glad to give him a ride.  Maybe he'll learn to become a little bit less of an ass.

The mug shot, combined with the video, showed a f*cked up, on something, man. I'm professional enough to see that. And another thing. For a moment, do not take the camera's perspective. Take the literal visual perspective  of the police officer. Here goes: 1. Guy #1, Beatty, pulls up at front of store (no one knows how long he's been in the vehicle before he got out BTW). 2. Camera guy (#2) pulls up in a vehicle on the side of the store (again, no one knows how long he's been parked BTW). 3. Camera guy gets out of vehicle, walks diagonally across the private business parking lot to .#1, and conceals their arm-hand interactions from the police officer. They both, from the cops perspective, can be seen moving their shoulders and outer arms, cop cannot see the camera-phone filming, but he can see that extended interaction is occurring. He comes over, rightly, to briefly investigate, and gets an attitude problem that can only be called brat-like. Brats escalate resistance, Camera guy is jawing off and, everyone seems to forget IS THERE behind the phone. To the cop, this looks exactly like a drug transaction. Either he has been SET UP for this, or these two chuckleheads, pants-on-the-ground Beatty and dickhead camera guy, have so little situational awareness that they do not realize how they appear to be transacting drugs on the street. It's not obvious from the video, but I would bet doughnuts to dollars that prior drug dealing and prior extended loitering drunkenness had been going on in and around that parking lot, as well, further justifying the police officer's actions.

I know I'm being offensive, and I'll apologize to regular Farkers. But, whoever pulled/filmed/enacted this shiat and then submitted it needs to also apologize for f*cking with the cops head and f*cking with the heads of the extended online community at large. Please people, don't be suckers/marks/sissies about this. The filming person and Beatty were in the wrong. End of story.

plainclothes cop doesnt show ID I would not even acknowledge him. I hope the guy arrested gets a massive payout like a white guy would .
Cop should be put to death after being on video showing he is a danger to society.

There is no possible way this is anyones fault but the cop, and if you are trying to blame the black guy you are fn stupid.
