The showdown is inevitable.

That brings to mind a rather hilarious image of a bunch of cops trying to buy pot to replace it.

Be sure to get a producer credit when Judd Apatow makes the film in 3 months.

Is it?  City of...County of... This will be resolved in state, and probably never get to a federal court.    Now, if a federal authority had the pot, then...

If you get a speeding ticket on a given road, and later the speed limit is raised above the rate at which you were cited, you probably won't get a refund on your fine either.

I also thought that was what this was about.  Except then I read the article.

I'm against the War On Drugs. Pernicious thing, that.

Also, this is a State challenge to Federal Authority.

I'm in favor of the States - as I don't see where the Feds ever had Constitutional authority for the ban in the first place.

How terribly interesting that a stoner without a valid drivers license was caught speeding/smoking pot while driving, and rather than celebrate the fact that he WASN'T arrested and charged for any number of major violations (including DUII), we are talking about his multi-jurisdictional legal challenge for a "small amount of pot".

So some pony tailed 20 something is paying this lawyer to challenge and appeal this?  I don't farking think so.  Just TALKING to the attorney would cost more than "a small amount of pot".  This is costing someone 5-10K$ minimum and I would just love to know who.  I think why is self evident.  This legal battle has been brewing since they voted pot legal up there, and I'm strongly of the opinion someone is using this guy to make that battle happen sooner rather than later (and in the process set some precedent that can be used in a more difficult case somewhere else).

Also, I'm getting a kick out of the judge in this.  I have a feeling I would like operating in his courtroom.  Contempt of court is funny because there is no real crime involved.  Either you pissed off the judge, or you didn't.  If you did, god help you, because no one else will.

Not familiar with pot, but is it even any good at this point? Does it go bad if left unsmoked for that long?

Good news is that is an incredibly easy thing to do even in prohibition states. Should take about twenty minutes.

I talked at length with a regional director of the DEA. His stance was basically this: "I don't have a moral issue with drug legalization. I have a legal issue: clarify the discrepancy between state and federal drug laws. Tell us what to do. Or not do. That's really it."

Sure, why else would they give a judge shiat about returning it? You don't challenge a judge's authoritah. He'll throw you in a room and throw away the room.

People say this sometimes and I understand the sentiment.  At the risk of feeding a troll (or not...but your post comes across as one), I just have to ask:

What are druggies to you?  One pill a week?  A shot of bourbon a day?  I would like to know the parameters of your assertion before I have any type of emotional response to it.

"Appeal or comply," Emery told assistant city attorney John Walker. "Or next week, show up, and I would advise you to bring counsel."

Seriously.  When I read that the dude and his attorney both had ponytails, I pictured them as Penn Jillette and Paul Heyman, respectively.

basemetal: So, was he pulled over before pot was legal and then the possession charge dismissed after it was voted legal, is that right?

He had a medical card, which Washington both recognized and didn't (the possession law still being on the books and not referencing the medical law) before the full decriminalization vote.

The question is, was he smoking it while driving?

If yes, I'd say that he needs a really good kick in the nads with steel-toe boots and left in the middle of the woods.

I wouldn't agree with him drinking and driving, I wouldn't agree with someone stoned and driving either.

America has some serious issues, but our system of separation of powers and rule of law usually gets it right.   Usually.

Depends how desperate you are and how it was stored but since it was most likely smoked by the cops then it's kind of a moot point.

A judge that sides with the law the people voted for?!  What's next, a Congress that votes according to what's good for the people?
