Miranda rights can be waived under the "public safety exception." Like if Joker Zangief or whatever his name is knows about more IEDs in the area, he can legally be interrogated about that in the interest of people not getting blown up without a Miranda warning. Once it's determined that there's no threat to the public, he's read his rights and questioned further about why he did that, who taught him bomb-making, etc.

This is not a new thing.  All it means is they are reasonably sure they can convict him without any of his own testimony, and want to make sure there are not any follow-up attacks in the works.  Anything he tells them right now is inadmissible in his eventual trial.

What? I had read he ran over his brother while escaping, but how the hell did they have his brother in handcuffs while he was still able to get in the drivers seat and drive off?

Well, I did read the article and I looked at the pictures.  The headline is right.  This is not in any way over.  The picture shows the cover on that $200,000 boat cut wide open, thus exposing it to the elements and probably causing irreparable damage.  Not to mention that the story indicates that the police and FBI who showed up after the 911 call shot a bunch of holes in that $2,500,000 boat.  I'm sure the boat owner will demand some compensation for the fact that they destroyed his $5,000,000 boat.  With matching $175,000 trailer.

This probably isn't true, but technically it could be. If we are under immediate threat of a terrorist attack the Patriot act can invalidate the requirement (but its still an option) to read someone their rights in an emergency situation.

seriously though, on all the illegality of enemy combatant, public safety, nat. sec etc. I've always thought that it falls into the it's better to ask forgiveness than ask permission category. really if you really think there is imminent danger of bombs, mass shootings whatever, do what is necessary, just don't pretend that it is legal or right. Use the immanency as  a mitigating factor at your trial, if your not willing to take the heat, my bet is it's not all that imminent, so you shouldn't be doing it.
The state should not be allowed to exempt it's agents, If you think someone has planted bombs all over the city and you torture them to get that information and your right, few juries are going to send you up for life, and even if your wrong your still going to get off lighter.
The alphabet soup needs to be held accountable even if it IS necessary, not immunized in advance which is an invitation to abuse.
