I agree about the DWI, not sure on the open container. My understanding of the law (around here, anyways) is that a year-old empty beer can rattling around under your car seat can be considered an open container if the cop really wants to be a dick about it. Even if the bottle contained water, it's still technically an "open container".

What evidence did they have of what was inside the pipe?

Some pot head claimed it was pot?  Did that pot head have a chemical analysis done?

That's what we were told when I took my mandatory class ran by the state of PA after getting a dee wee.  Law doesn't specify if it contains alcohol or not.

I do hope the police fully investigated the crimes before showing up to arrest people.   As in this day and age it is very common to have an online persona who does not act or 'think' like the person running the keyboard does.  Often using nicknames or when possible.

And in a world where video editing software is common place a bottle of 'Becks' might not be a bottle of Becks.  As an example.

I'm in the "get off my lawn" contingent myself (approaching AARP eligibility), so I'm getting a kick out of that. A heartening thing to me, at least, is that some kids are at least starting to wise up about the implications of posting things online - especially under their real name.

If he opened a fresh bottle in the video, I think it would be enough evidence to sway any judge.  It would be noticeable the tamper proof sealing was in place and the contents then would have to be beer.
