I seem to remember there was some TV commercial from an insurance company where a guy talked about working for them and developing no-slip flooring. It specifically mentioned grapes as being more dangerous than bananas. Anyone else remember that?

grapes are slippery as shiat when on the floor... I work in a grocery store, I know. I've slipped on them before.

the stores know it well, when you train they say be sure to pick shiat up... they call it the 25,000 dollar grape. I guess they can call it the 41,000 grape now.

I don't want to start a flame war but COME ON !!!! Doesn't anybody takes their own responsabilities in the US anymore.

You didn't look where you were walking? your fault.

Does that mean you can sue the ski resort where you brake your leg because the snow wasn't soft enough...or your last girlfriend for inflicting emotional damage when you broke up? I am sure there are cases like these.

How about sueing the shoe manufacturer too for not making the shoe slip-proof... I swear this never EVER happens anywhere else than in the US.

Bottom line is that it is never the idiot's fault for anything...it HAS to be someone else and since people are force fed crappy lawyers commercials begging you to sue your employer because you feel at work it only means one thing:

The legal US system is farked up and the whole world laughs at it. Maybe also one of the reasons other countries consider us to be morons.

one great thing about Wal-Mart: they have never settled a lawsuit outside court. ever. they make the plaintiff attorneys fight/win every dime. Wal-Mart has refused to settle for one dollar, based on principle.

For people to sue for large amounts of money for slipping on something is ridiculous. The supermarket should pay for medical, and the lady should have to prove her lost wages. I seriously doubt that this lady lost over 41k on this accident.

If I were to to be driving down the road and hit an ice patch and run into a lightpole, could I sue the city? Just because they clear the roads does not mean they are responsible for it, people need to be aware of their surroundings. I feel this case is the same way. If you are in a grocery store, usually messy people will drop things or water from produce will be leaked onto the floor. This is how it is everywhere, be responsible for yourself.

I'll have to take the instigative side on this and agree that grapes are one of the slickest things you can slip on and they can be very hard to see. Especially if they are white grapes and even worse if they've already been stepped on or crushed.

In Chris Rock's book, "Rock This!" he wrote about how brothas in the hood will try to get hit by a car for the insurance money. It had to be a white person with a decent car -- more likely to be insured. Then they just jump out in front of it, and get a settlement check a few days later.

And when you hear about it you'd be jealous. "What? D-Mac got run over again? Third time this month. How does he do it?"

i hurt myself by slipping on a grape and stopping my basket from crashing all over the place. pulled a muscle in my ankle and smashed my elbow pretty good.

if i needed medical attention (which i didn't) or couldn't work (which i had to anyway cause i needed the money) damn right i would've sued.

i mean cmon, concrete floors may not look pretty, but at the markets with cement floors you never slip on anything. those pretty white tiles are not safe but easier to clean.

well ill be, i used to work for farkin safeway the shiattiest store in the world. They gave us like 14 hours of training about an hour or 2 of which was picking up grapes and other things off the flood so stupid people wouldnt slip...

Problem is that concrete floors are less sanitary and more likely to soak up slime from dropped produce which then starts to rot

I've seen some stores lay down big-ass floor mats in produce sections to prevent this kind of stuff.

It also helps to wear shoes that aren't perfectly smooth on the bottom.

But I have enough "downforce" and large enough feet that a stupid grape isn't going to send me to the floor. A squashed cantaloupe or other melon-type fruit might.

I hate frivolous lawsuits as much as anybody, but the article doesn't tell us enough about the woman's injuries to determine the frivolity level.

My mom slipped on a grape at the market (in the produce section, not the checkout line like the woman in this case). Her kneecap shattered into pieces from the fall. The rehab lasted several months.

She was bedridden during the early stages. As the healing began, my dad or I would help her get her leg onto a machine that would move back and forth, bending and straightening her leg, with a gradual increase to the speed and flex over time. She endured a lot of pain, but a year after the accident, she was again able to go for her 3 mile health walks. All in all, it was a pretty impressive recovery for a 66 year old woman.

My mom was still a full time worker at the time. She missed a full year of work and she endured a long period of being immobile. The store's insurance company offered $10K. Mom didn't want to go to court, but the insurance company eventually offered $50K, and the settlement was accepted. With the lawyer keeping a third, my parents netted about $33K.

Given the limited information in the article, we really don't know if we should be casting stones at this woman. Of course, it wouldn't be Fark without the stone-casting.

I also spent two nights in Council Bluffs, stranded in a blizzard en route to Colorado. A story I would tell, but for its lack of relevance.

I don't think it's the woman's fault for *slipping*, grapes can be very slippery and they're small enough that it isn't that stupid if you didn't spot it. But on the same account, it isn't the grocery store's fault either. When you sell grapes, sure, occasionally one will drop on to the floor. If you see it, you pick it up but unless the entire floor is covered in junk and they clearly never sweep up, it's just an accident, no one's fault. A grocery store can't possibly prevent the fact that sometimes, for a short while, there will be a grape, or a tiny piece of wilted lettuce, or whatever, will be on the floor. *Only* if the floor was a mess in general is the store negligent and responsible.

And ImpyChipmy, how severe the injuries are is *NOT* an issue. 'Real accidents' (something that no one should be blamed for) happen, you shouldn't be able to sue for them. Our local store is reasonably clean, I wouldn't think of suiing if I slipped on something as small as a grape even if I were disabled for the rest of my life, because I realise they can't have someone watch the grapes 100% of the time (and no customer who hasn't slipped on one would stand for the cost of such, or would accept it if they asked the 'floor guard' a question and were told 'sorry, I can't help you, if I turn my back for 1 minute someone may drop a grape').

Sometimes shiat happens, eat it. Don't blame someone else.

What are the chances of this being staged? I've seen store surveilance video of people putting stuff on the floor and then "slipping" on it.
