Oh, are we back to cheering on the Oatmeal while he openly mocks a crazy person?

"I still think that Matt Inman is a great big bully," he said. "I'm glad that I stood up to him. It would have been nice if [this whole saga] had happened in a different way. I didn't lose any clients as a result of FunnyJunk. I've gotten new clients since then. I know there are a lot of people that wish me ill, and I don't wish them ill in return.

Yes, that guy who draws webcomics and pointed out that content aggregation sites (Like ebaumsworld, funnyjunk, and 9gag) slap their logo on other artists' work and make money on it. Truly a monster.

2013-04-12 08:13:00 PM
Wait, lawyer fees in the amount of $200 comes out to "only" $70 per hour? So, that's less than 3 hours of work and the final bill comes out to an appropriate $15,000 per hour?

I need to get into lawyering.

Great, now the Oatmeal guy can get back to doing quality humor about binders full of women, the Mayan Apocalypse and defending rape jokes.

Yeah, what an idiot. He should have just given the guy the $20k and let the poor crazy person go on his way. What a jerk, being mean to the obviously imbalanced lawyer threatening legal action. Twenty grand is pocket change to a guy who makes webcomics- the guy even has BOOKS now. What an ass. Should have just ponied up and left it at that.

We cannot really judge this lawyer for what his mom does to fuzzy forest creatures.  However, we have more than enough to judge him on his own screwed up actions.  And those actions are more than anyone can bear.

An idiot with the legal authority to extort $20k from the victims of IP theft just because they're poor.

Inman stood up when others COULDN'T. Not everyone has enough fans to amass $200K in a week. The lawyer might be an idiot, but until he's dead or disbarred, he's a very dangerous idiot.

Because he wasn't the one trying to sue a webcomic artist for complaining about another site illegally hosting his work?  Seriously, Inman could be a confirmed child rapist and Carreon would have been the bad guy in this situation.

The reason he's an Internet hero is that he took down a notoriously bad person who NEEDED to be taken down, did so in a way that maximized public Schadenfreude over Carreon getting his, and also raised a bunch of money for two very good charities in the process.  The act in and of itself raised him to "hero" status, whatever his standing was beforehand.

The real pity here is that Inman can't effectively sue these aggregate sites and put them out of business, because they would simply move to a country where their activities are sheltered. Every time I see a 'funny pic' linked on Facebook from 9gag or other sites like it, I don't think "hey, that's a funny pic!", I think "who did they steal that pic from?"

/Yes, I have had my work (a video podcast I used to do) stolen by an aggregate site.

Keep in mind that hourly billing is the only way a law firm can make money- by law, in a lot of places. So that pays for rent, the salaries of everyone else employed by the firm, pro bono work, utilities, you name it. It's a really crappy system in a lot of ways, but it's pretty damn entrenched, not least of which because it's the mechanism courts use to determine fees when the loser has to pay the legal bills. Most lawyers hate it too, it creates a lot of pressures and perverse motivations for them, but there isn't much way around it.

Also, that's not the right numbers comparison. We don't know what numbers the judge was looking at when he said that, because what we have here is an example of shoddy journalism. $350 is a more typical rate for a partner at a decent regional law firm. Big Law partner time just hit the $1,000 threshold recently, and most of the legal profession thinks that that's utterly insane.

Lawyers cost money. In the case of long, drawn out court battles, they cost a lot of money. Not having one usually costs you more money.

The numbers are high- because this douchebag tried to screw over Inman by dicking around when he knew he had no case, with the specific intent of driving up Inman's legal bill. Normally, Inman would have been left with the check, but in this case, the judge noticed what cockbag was doing, slapped the douchebag down hard, and stuck him with the check.

This judgement has nothing to do with Inman/Oatmeal.  "Satirical Charles" sued Carreon and it cost his lawyer $77,765. So, he and/or his lawyer are out $31k.  This is why people don't sue even when they are in the right.  Also, good luck getting any money from Carreon in the next decade.

Its got less to do with right or wrong and more about using the legal system as its own form of blackmail.
A lesser target would have been so overwhelmed by the costs of going to trial that they'd have settled, which means free money for anyone with a bone to pick and the time to file paperwork.

way south: which means free money for anyone with a bone to pick and the time to file paperwork.

That's all it's about really. Even though there's a cost with filing, getting just a few people to pay up turns it into a windfall. And all without ever worrying about a lawyer showing up and filing a motion asking you to show cause. Or even getting to wear a judge might ask.

SpiderQueenDemon: Isn't there a 'vexatious litigant' protocol for dealing with this sort of thing?

Yes there is, but it's meant to be applied to the claimant (e.g. Funnyjunk), not by some douchebag lawyer who represents (or claims to represent) the claimant.  In the case of an abusive lawyer they'd go the Jack Thompson route and disbar him so he can't bring any case in the state as a lawyer (or like in Thompson's case, make it so any case he's involved in has to be brought by some other lawyer).

Also, I too like Inman's cat drawings.  So does my (now ex-)girlfriend.  I made her this as a user avatar:

Vexatious litigation is taken into consideration a few different ways, in this case the Lanham Act. The initial legal proceeding was not on the surface vexatious, however what came later, most certainly was. Thus now Carreon is on the hook for legal fees.

As a law student, I have a personal and professional interest in things like this.  Lawyers have a bad enough reputation, some deservedly, some not, and crazies like this guy absolutely don't help.  There are entire libraries worth of books devoted to extortion, vindictive and malicious claims, harassment and nusance suits, and everything else Carreon's pulled.  This guy, his methods, and his tactics are an embarassment to the profession, and who knows how many times he's pulled these same methods on people, had them work, and nobody knows?  Sooner or later, a guy like this needs taking down, both as a duty to society and as a cautionary tale to the rest of the field, and it's both an honor and a pleasure to watch on as he gets his at the hands of the same system he's been abusing.

/Plus there's a certain amount of hopefulness in knowing that someone like this actually managed to pass the bar.  Means I might have a chance after all.
