Chief Walker says juvenile authorities will decide whether to press charges against the 14-year-old who hit him.

Okay, that's insane.

Some people just die. It happens. There was obviously some kind of underlying heart condition neither party knew about and the victim was older and consenting. If they had known there was a risk of dying, they wouldn't have done it. They were just boxing, which we've all done with our friends in high school. It's what young men do.

Not only that, but this kid just watched his friend die. Do you have any idea how traumatic that can be to a person? He'll live with that forever. Charging him, indeed any kind of legal action civil or criminal, will just be meaningless cruelty on top of that.

i used to get drunk and play the 'punching game' but we hit each other in the arms. punching someone as hard as you can in the chest is pretty farking stupid.

Yeah we used to do this but called it "trading blows". It was swell because being the little skinny guy with sharp knuckles was actually a benefit for once.

Looking back I find both the activity and the name we gave it suggest that we may have been idiots.

Oddly, Gyr, doglover's comment is what inclines me more toward charging the kid. It smacked too much of the "boys will be boys" excuse for teenage bullying, sexual harassment/assault, and the like.

I grant a significant difference in that the victim here was a willing participant. But say I'm playing mock Russian Roulette with a friend and we both believe the gun is unloaded. Only it's not, and I shoot my friend dead. Better believe I'm going to jail for manslaughter or involuntary homicide.

Some behaviors are too dangerous to lawfully engage in. By anyone. Of any age.

And of course I'd feel differently if it was my kid who did the punching.

I heard about this before. The article I read [citation needed] was about kits being hit by an errant pitch while up at bat in little league baseball. Apparently there is a narrow window of time during a heartbeat when a sharp blow can kill you. Dead.

Man, when I was in mid school (sometime during the Pleistocene) we played bloody knuckles, not this punching other in the chest stuff. Even back then we'd heard stories of kids being killed by a blow to the chest (usually in baseball) that happened at the exact wrong part of the cardiac electrical cycle.

The problem is that just punching someone in the chest ISN'T "too dangerous to lawfully engage in" unless you think that merely touching someone is criminal battery. It is, in fact, just boys being boys, and here's why:

As was discovered a few years back, teenagers especially are prone to a type of cardiac arrhythmia, where a sudden sharp blow to the chest during normal heartbeat can stop your heart. That was learned, IIRC, when kids in Little League were getting hit in the chest by baseballs. The dead kids had no prior heart conditions, no malice or bullying or harassment or assault was intended--the pitcher threw the ball, the batter missed, and he died. It's just an awful case of really bad timing.

When we were kids, the arm was the preferred target; but yes, boys WILL be boys because it's all about the testosterone, especially at that age. Quien es mas macho? The legal question is whether there was malice (intent) and whether the participants had a reasonable understanding of the risks involved. In your Russian roulette case, we all know the answer is that guns are never unloaded. But in this case, the idea that two unskilled kids could punch one another so hard that one could die is not a reasonably assumable risk. Nobody thinks that's a possible outcome, even if you've heard of the kids who got hit in the chest with baseballs, because who thinks you can punch as hard as you can throw a baseball?

I'm not prepared yet to make all physical contact, even rough physical contact, a matter for the courts, merely because a potential exists for death under a particular confluence of circumstances.
