One cannot be deemed an "idiot" in a court of law.

This guy wasted the courts time and for that he is being punished.

Yup. When I read the headline, I thought, "Again??"

I'd imagine he'll pay, but a lot less.  Unless this guy has significant assets can be shown to truly be trolling the courts. The important thing though is making him pay at least court costs for this incident to show you can't troll the courts as a retirement hobby.

They certainly can. But it's more of a defense than a charge.

Frivolous lawsuits contribute to a larger government.  Dick.

FTFA:

Apparently Strunk had written 20 previous lawsuits. Most have been dismissed

Somehow I doubt those prior lawsuits had any more merit than this one.

Any legal expert care to chime in?  I mean, how hard is it to overturn fines like this that are imposed by a judge?  I'd imagine not easy...

2013-04-05 03:01:43 PM
Can this guy still file new lawsuits with 177 unpaid big ones hanging over his head? That would seem to be a very sensible way to shut him down, if not. Even if they never actually get any significant amount of that money out of him, it'll be worth it in the long run if nonpayment is sufficient grounds to bar him from filing any more bullshiat lawsuits.

Can you get cited for contempt outside of the courtroom?

Now now, both sides have their share of nutters. Just that right-wing nutters burden society in extra special ways.

For failing to obey a court order / judges order.

Change that blue suit to a pair of bib overalls, put a straw hat on him, and he'd feel right at home here in Texas. We have a large supply of nutters just like him.

Most contempt happens outside of court. Ignoring the court and not showing up often results in contempt rulings.

Here's a strategy: buy the judgment against him and plague him with legal action until he pays.  It works in the credit card business.

Mmm, I think I misdirected my snark.  Yes, frivolous lawsuits are bad.  Yes, Republicans say they are against them.  Unless, you know, it involves pointing out the derp of a large number of their supports.

But you carry whatever card you like ;)

2013-04-05 03:10:50 PM
Had it been the guys first lawsuit on the issue than I may have been irked by the Judge's fine. But 20 previous ones? Come on your time would be more productive arguing with trolls.

Seriously though what do people honestly hope to accomplish with this? Making sure Biden gets to be president.

A few days maybe weeks of news coverage would occure before people went back to their normal business and by the next election they will have virtually forgotten about it.

If appeal is denied, then the original ruling stands and a bench warrant can be issued. Paying up, going to jail, or fleeing the country to a place with non-extradition treaties are the Birther's options.

Only the lawsuits against corporations that "donate" to massive "campaign contributions".

I am not a lawyer but I seriously doubt that having (what I assume to be) a civil judgement against you in one court legally bars you from pursuing litigation, even in that same court. Now, how the presiding judge will view that litigation is another matter entirely.  Just from my experiences with district and federal judges outside of a courtroom setting I can say that they are typicallypretty goddamn impressed with themselves and it is best not to poke at them.

I'm almost 100% positive you can't be punished for being an idiot in America. At least I have to assume so, given the idiot to punishment ratio.

Before long you will start seeing the claims that Biden is not eligible to run for President in 2016. This is because the Muslin Usurper was never really eligible to be President and so for the past 5 years Biden was really President.

He's being fined at a rate of $10,000 for each major idiotic thing he's done, and $1,000 for each lesser idiotic thing. Trivial idiotic things he gets a pass on.

So far the fines have added up to $0.

/wonder what that means...
