I'm a little suprised that so many people here and in TFA comments look at this as a sexual attack or some sort of rape.  If he'd jammed his foot down the guys throat, killing him, would it still be a rape murder or just murder?

Hmm now this got me thinking. What if two men were fighting over a girl (like in the story), except that this time, it's the girl who got drunk and the guy shoved his foot up the girl's butt and she died? Would it be considered rape and murder, or just murder? What if the guy says it's not sexually motivated? What if the guy says it was? Does proving whether it was sexually or not sexually motivated change what punishment the guy should get for shoving his foot up the girl's butt and causing her to die?

I believe the penis, vagina, breasts, butt are sexual body parts. If these body parts are attacked, does it mean there's sexual molestation or rape that just happened? If a killer enjoys cutting off the victim's sexual body parts by grabbing them and then using something sharp and he achieves "climax" by doing so, but he never penetrates the victim with his own sexual parts, is it still rape? What if he never climaxed?

I wonder how cases like this were judged before, very interesting :o
