That was my thought as well.

The problem seems to be that the elevator is already built and has a variance that allows it 40 extra feel. Even buying the building doesn't necessarily mean he is going to be able to get the permits to tear down the elevator.

It is harm, and possibly irreparable at that.

No, I'm saying that the skyline is defined by the buildings you can see from your current location.  By definition you can't block the skyline with another building, because the other building is PART of the the skyline.  It would be like saying that a tree at the edge of the forest is blocking your view of the forest.

There was A LOT left out, I always tell people that the movie is the beginning, middle, and end of the book.  Also they did a better job at explaining the ending of the book than with the movie.  Admittedly though, it's a bit darker sometimes than most people are comfortable with.

Even if the top of the shaft housed the utilities for the elevator, 42 feet seems excessive. I used to design 160 foot tall feed mills that had a service elevator in them the entire height and the utility room at the top was only 5'-6" tall for everything. So, 42 feet taller seems like they were going for having the tallest building in the area type of claim without actually having the tallest building in the area...

Elevators usually need an over-run of one floor plus a bit, so they can be hoisted up and serviced. There's often an elevator room on top of the building where they house the pulleys and machinery and can pull the whole elevator out for repairs and servicing. Higher buildings have larger elevator rooms.

If it was REALLY about the "zoning laws" there wouldn't be an issue; but we all know it's not about that. Any more than when some douchebag sues because his neighbor's 150-year old tree is violating a "zoning ordinance" because its branches stick out six inches into the thoroughfare, or another asshole sues because the kids' lemonade stand violates a "zoning ordinance" that prohibits conducting a business in a residential area. Yes, it's true that there might be a case to be made that the tree, lemonade stand and elevator do violate the letter of the zoning law--and it's also true that in all three cases, that is not what Mr. or Ms. Douchebag Asshole is suing about.

Zoning laws are not there because the city cares if anyone has an unobstructed view, or for any pixie-ass reason this guy may have or you may imagine. They generally exist so that there isn't heavy industry in the middle of a residential area (or vice versa) or so very tall buildings don't emerge in the middle of established flight paths or block necessary airflow into or out of the city, or what have you. I guarantee this jerk did not give a rat's ass about "zoning laws" before this elevator shaft suddenly appeared on his horizon, or worry if any other building in the vicinity was compliant with the zoning regs. So we have to ask: Why does he care about this one so much? Answer: Because it bothers him personally, and that's the only reason.

Let him have his money. I could care less if he wants to have a Roman orgy nightly and snort pure Colombian blow off of virgin hookers 24/7. It's his money, let him do what he wants. But he didn't buy the sky. So suing someone over a bump in the skyline and pretending he's developed a sudden concern over Manhattan's zoning laws is pretentious asshattery of the kind that makes the 1% look like the evil moneygrubbing whores they are.

All you farkers are so quick to jump on the "hate-the-rich" bandwagon ya mindless sheep.  This guy is not threatening some senior citizen over a tree or stomping on some poor kid's lemonade stand, he's taking on a major advertising firm that wants to throw parties on an open rooftop bar next door to where people live.  He's not the only citizen against it, he just gets his name in the paper because he is the only one with the money to fight it.

that's what I'm planning to do in my neighborhood.  Lots of run down houses, gonna buy them and fix them up and sell them for a modest profit.  Make the place nicer, bring in more people instead of an abandoned wasteland with 3 or 4 houses actually containing life.  Keep the property values low--higher than they are now, but low, affordable.

It appears the majority of people in this thread hate the man.  Not because he is a bad person or has done something offensive, merely because he is rich and would like the local zoning ordinance enforced.

One of the reasons people purchase property in certain areas is it is zone in a particular way, and they can depend on that to keep their property values high and keep the area looking nice.  I don't make enough money to ever own a roof top suite, but I know that if someone violated my local zoning ordinances and set up a trailer home in an empty lot in my neighborhood, I would complain and expect it be removed.  I might even bring suit.

Same for people who live in historic neighborhoods that depending on the historic zoning to preserve their look and feel of the neighborhood.

There is nothing in the law that state, that after you make a certain amount in annual income that your right file suit to have the law enforced automatically disappears.

While zoning may have originally been created to prevent mixed uses in resident or industrial areas, it grew to include aesthetics. Why else would there be restrictions on house size/lot size or mandatory setbacks in residential areas? I'd be surprised if this guy's lawyer didn't do his due diligence-before the guy paid a fortune for this place-to assure him of the zoning and that he would be unperturbed by the potential further development of neighboring buildings.

Per the article, the only reason this guy is suing is to enforce the law. It seem petty, but the neighboring rooftop party area has probably already decreased the value of his apartment. If he ignored it and every other building built up to his apartment or higher, his property would be worth significantly less than what he paid.
