Appeals court decision here: http://www.3dca.flcourts.org/Opinions/3D12-1510.pdf.

Formally this only reopens the adoption proceedings and he might still get away with it. One of the three judges added:

I entirely agree that the final judgment of adoption is a nullity. Even if the motivation and the means for securing it were not so reprehensible, I believe, as the New York Court of Appeals held in In re Adoption of Robert Paul P., 63 N.Y. 2d 233, 236 (1984), the adoption of a paramour is so contrary to the beneficent purposes of such an action that no such judgment can ever be sustained.

What happened to respecting people's beliefs?

Who is the government to decide who can/can't be adopted by.  Or who you can/can't marry?  This is as backwards as not allowing blacks to vote or not allowing gays to marry.

If same sex marriage is made legal, what is to stop a father marrying his son to make sure 100% of his fortune is passed on with no inheritance taxes... just like husband to wife.

FYI, I am for same sex marriages, but I find the legal implications very interesting.

I'm of the mind that ALL legal benefits need to be removed from being married, so the only thing about it is a pledge to one another.

The government should be interested in protecting any children that might arise from the marriage, both naturally and through adoption... and somehow find an equitable way to compensate on partner that decides to stay home to raise the kids... but anything beyond that is questionable.

After going through a bitter divorce.. I am of the realization that at any time in a marriage, one partner can basically turn the other into an ATM without any recourse... basically, it legalizes one partner to be a parasite if they so chose.

Lots of 40 year olds have meaningful relationships with their parents.  It's wrong to legislate the love shared between a parent/child because someone is outside of the 'idea' age.  'Sorry - if you don't enroll in college before 20, you don't get to'.  'Sorry - if you aren't married by 30 - you don't get to'.  'Sorry - if you didn't adopt someone before they are 40 - you don't get to'.

When they found out my grandfather couldn't make babies my grandmother's sister took her out one day, they came back in and told my grandfather they were going to adopt. My great aunt had found a boy for them to adopt.

"How old?"
"Seventeen."
Screaming, yelling, and the girls went back out the door and forgot that idea.

It didn't work then either.

Actually adults can't be adopted because they are viewed as being at or above the age of majority.

Not saying this is always the case but that's the over-all general view.

1. All states have laws forbidding close relation marriage. The fact that they're of the same sex is irrelevant.
2. Minors cannot enter into legal agreements, including marriage. The exceptions are in states that allow it with parental permission. Even so, point one comes into effect.

IANAL but I presume incest laws (which I think are mostly governed at the state level) may be written to prevent marriage between close family members.

Which is arbitrarily discriminatory.

My parents are given rights that extend well beyond me reaching the age of majority.  By not allowing adoption, you are making those rights unavailable to non-biological parent/child pairs.  Not fitting your personal definition of what is 'right' shouldn't limit someone's ability to live.  Equal rights for everyone.

Either - when I turn 18 my parents are legally viewed as strangers since they are not related to me; or allow adoption of any age so that people can choose to give those rights to someone of their choosing.

In 30 years, you'll back and feel awfully silly for your discriminatory beliefs.

Incest laws are absolutely unfair and discriminatory as well.  I know people will label me a troll, but it is JUST as arbitrary to say, 'Two men can't get married' as it is to say, 'THOSE two men can't married'.

People have been against inter-racial marriage.
People have been against gay marriage.
People have been against polygamous marriage.
And people have been against incestuous marriage.

And it's all just close-minded people forcing their viewpoints, their lifestyle on others.

Consenting adults should be afforded the same rights as everyone else.  Anything less is wrong.

I agree, the best way to solve the 'marriage issue' is for the government to get out of the marriage business.  They're the one causing the problem.

There's no law that says 2 people can't get together, have a ceremony, and call themselves married, but it's the government treating different people with different rights is the rub.

Solution, no more government-sponsored marriages.

That might have been a meaningful argument -- by which I mean, the guy's team of lawyers might actually have tried to adopt it (no pun intended) -- except that it's obvious to all concerned that the adoption isn't to further a romantic relationship.  It's an attempted end run around possibly having to give up some money.

Dude's an assbag and should eat a bullet.  But I would be interested in a similar but non-scam situation landing in court and the lawyers trying to use the argument (trolling or otherwise) that you propose.  I don't agree with it, but I'd like to watch the arguments presented.
