I think even without the paying his nephew thing, it should be considered attempted murder. If you try to kill someone with a gun, and it turns out that it's a toy gun that does nothing but you didn't notice, is that somehow ok? You still intended to kill someone. Same with rituals like this. Just because many know it's ineffective, doesn't mean it wasn't an attempt to kill.

Um, point not quite made. Any more than praying for someone to get in a really nasty fight constitutes assault, or wishing really hard for someone to lose their job constitutes removal of means to support life. There are people in first-world countries that believe you can do all these things, and there is a word for them- delusional. If you really are terrified that a neighbour you don't like might be performing a secret ritual to hurt you, then move to someplace like Saudi Arabia or various African nations where you can still make legal accusations against people doing this.
