We're really shooting our load prematurely over this gay marriage thing aren't we? Five or so threads a day just isn't enough apparently for everyone on Fark to unanimously agree about it.

There won't be a decision for sone time and don't be surprised if the Court rules on procedural grounds or limits the decision to only be applicable to this case.

In other words, don't hold your breath for Federally recognized gay marriage as a result of this. But hey, I guess gay marriage threads are slightly less annoying than gun threads, so that's a plus.

I think the prop 8 will be kicked to the state, leaving it to the states to decide and the doma will be struck down so that the feds recognize legal marriages in states that allow it.

Narrow enough that it sets up a future fight.

As much as I disagree with the attorney, what he was trying to say was different than what has generally been reported:  his point was that marriage deters the partners from procreating outside of the couple.  So an elderly man, while not having babies with his infertile wife, will not create a child with another woman.

/it's kind of a dumb argument, but not as illogical as had been reported

I'm pretty sure if your argument gets laughed at in a Supreme Court proceeding, you're not doing very well at all.  There was no need to "pin them down."  The point had already been made.

How about a childless marriage? Does it get annulled if the couple does not produce children? Or a couple who didn't want children but wanted to marry? The reason marriage existed in the past may have been for producing an heir and providing a legal means to keep property within the family after the owner dies, but that's no longer a totally valid reason. Besides, gay couples can most certainly have children; by the defense's argument, they should be allowed to marry!

My wife and I got married last year... knowing that we are not planning on having kids. I seem to remember the NC court not asking us if we are going to have kids. I guess they did not care whether we are or are not... so take that argument up your pipes Prop 8 lawyer.

The wife and I have no intention of having any children, yet our marriage is still quite legal and valid.

All the arguments against homosexual marriage are essentially a way to wrap up their one and only argument against legalizing homosexual marriages, bigoted religious dogma, in a secular package.

1: Your premise is bullshiat.
2: Biological reproduction isn't the only way to have a family. If it was, adoption wouldn't exist.
3: Considering how dangerous it is to actually reproduce after a certain age, getting hyped about 55-year-olds having kids is almost as retarded as the kids who would come out of such circumstances.

here's why his answer explodes his whole case.  His premise that the State's interest in defining marriage as between one man and one woman is that it provides  for a sexually exclusive relationship that produces children.   His answer to Kagan's question was:

Now, given his prior argument, how is it at all relevant that ONE partner may be fertile?
