Facebook isn't 'Real Life TM'.  It's a projection of what we want people to see.  Most people, particularly poor people, want to be seen as being successful (for whatever they view successful to be).  It looks like somewhere between $100-$200 in that picture anyway, even on welfare or minimum wage, it'd be expected for someone to have access to $200.

It doesn't say anything about how much he earns, spends, or what child support he can afford.  All it means is, at one point in time, he was seen standing near $200.  Big f***in deal.  I could be 50k in debt, unemployed, failing out of college - but take a picture with 8k-10k after getting my student loan check.

Realistically it's likely the result of him chasing his check at the local payday center (and losing 30% of the check to 'surcharges').  He took it out cash, when home, took the picture, and then had to pay out the money to his landlord and other expenses.  About the only thing the DA really has on him is liquor and other non essentials in the photos.  Although the guy can always claim they were leftovers from a BYOB style party.

What the DA really good out of this deal was the media coverage since the media loves a good "moron on Facebook story" and the DA gets some "think of the children" media cred.

Sounds like my ex.  When I got together with him he had children from another marriage.  I made sure that even if his work was slow, his ex got paid (with my money if need be).  Flash forward 17 years later, we are getting divorce, he  and I have a child together.  He decides that he is entitled to Spousal support, which conveniently is the same amount of money that I would have been paid child support.  He has not paid (nor is he required to) one dime of support for our child.  It's fine though, I'd hate to have to drag his ass to court to get it out of him, what would just piss me off more.

Are you kidding?  Facebook sleuthing is very efficient and productive use of tax dollars.

Its been said, over and over again, how she's ruining her own children's future by not collecting support on their behalf. Her oldest daughter is quite intelligent and could probably be college bound and if she started now, she might collect enough for some tuition by the time she gets into school (she's 13.) My inclination is that if she collects child support, she'd probably have to stop hiding from him and he'd have the opportunity to be in his daughter's life. From what I understand, he was a pretty upstanding dude (her mother told my brother this) and would probably force the issue with visitation. She uses the lack of formal child support and custody arrangements to extort money from her younger daughter's father. I have the impression that the younger one's father is in the US illegally, so going to family court might be off putting to him and cause him concerns, so if she wants money, she demands it and he coughs it up. He also does all transport - which includes air travel - for the summer visits.

I keep telling my brother, you can't trust her, you're in a bad place if she turns around on you like she's turned around on the other girls' fathers. The only comfort I take is in that she is married to my brother and whenever they end up divorced, he'll have to make proper custody arrangements for his daughter as part of the divorce. I think the other two got themselves in this position by being non-custodial parents who aren't married to the custodial parent. I am hoping a divorce lawyer could preserve my brother's rights and access to his child while also ensuring she is adequately supported should he not retain full custody of her... Its a pretty sick thing, but when your child is born within a year of meeting your spouse, your marriage does not scream long term union built on trust, common interests and true love.

Complicated.  If I was in your brother's shoes, I'd seek a guardian ad litem to represent her kids in an application for child support.  Of course, I'm nowhere near like your brother; that's just how strongly I feel about this issue.  I'd gladly fark a marriage to get justice for those kids even though they're not mine

I'll probably never be in such shoes because the instant I learned that a woman didn't pursue support for her kids, the relationship would be terminated with prejudice.

The judges live here too. Assuming the payor parents make an effort to come in and explain to the attorneys why they can't make their payments and not just let it slide. Or come into court and blame it on the mom's bad record-keeping. Or say "Hey, my boss said he'd send my check straight to her." Or wait ten years to challenge paternity on the kid they've been fighting over since its birth. (All excuses I heard at Support Services)

Come in, talk to the judge, and have a better excuse than you have to support your three new kids so you can't pay for the three kids with your first wife, and the judge will understand. And don't wait till your arrearage is in six digits.

You wanna share? The day my brother's baby was born, I found out because my SIL posted pictures of her on Facebook. Within 7 minutes of her birth. Guess who I unfriended because it was better for my own sanity? Oh, and my niece has 22 Godparents, but I'm not one of them because I'm not Catholic.

The thing I regret most is not buying him a plane ticket to "come visit" me after he broke up with that girlfriend. And by come visit, I mean have some sense talked into him by my husband about what it takes to be in a stable adult relationship. Instead, he got the wisdom of a bored married friend who thinks its helpful to get over your broken heart by finding random squish. He doesn't realize that my brother isn't that kind of person, he gets entangled with complicated women and complicates his life with their complicatedness.

Holy shiat, that's no way to enforce child support!  In Colorado, payments must go through the Family Support Registry, so there's independent verification of what's been paid.  The FSR screwed up a couple of times in my 16 year's experience with it, but the errors got fixed promptly with minimal effort (double-checked records; once I had to produce a canceled check).

Modifications had to go through court; the FSR even sent a check back to me because it was for more than the court order.  But mods were easy and DIY.  The ex and I  swapped 1040s each year, used a state-supplied spreadsheet to recalculate obligations, filled out the form and mailed it in.  Got a new order by return mail and went on.

I guess it only works for adults who love their kids more than they hate each other.

I currently pay just under 800/ month for my two boys. I don't feel extorted but I do find it funny that in Florida child support is not tied to visitation. Since I can't afford to drag my ex into court I do not get to see my kids because she decided to take them from me. Yay for Florida! I get the honor of continuing this stupid cycle for 5 and 7 years respectively. This is precisely what I get for thinking with my dick.

/I would understand if there was any reason on Earth for her doing so aside from her just being a vengeful biatch.

Where they get you is "shared expenses".

Dad made 28K, Mom made 90K.  After taxes, this became 24K and 70K.   Dad paid Mom $4300 in child support for partial support of 2 kids.  He's down to 20K.

At that point, Mom sends over bills.  Every summer camp got split right down the middle.  Marching Band, split.  Medical Expenses, split.  Birthday cards, split.  Gifts to teachers, split.  Dad has no option but to pay, and no ability to control the spending.  Dad ends up paying Mom to the tune of 10K a year in child support and shared expenses and basically going flat broke.

/It could be worse.  One of my uncles' had his ex-wife bill him for private school while sending the kids to public school.

That is a really shiatty thing to deal with and I'm sorry that is your reality, but I disagree entirely with the idea of linking visitation to support. My cousin's POS ex thought that if he ignored his daughter and never had a relationship with her that he shouldn't owe support. So she was unsupported and abandoned on top of it. That kind of thinking is the really unfortunate inverse of your problem. I hope your vengeful biatch gets what is coming to her and your boys aren't too hurt by this mess she's created of their life though, because I fully believe that the obstructing parent who has vengeance in their heart will be left to suffer once their children learn the truth. I've seen it happen with people I grew up with, they thought their fathers were deadbeats or didn't want them, but learned later it was their mothers who kept them away from their father and their mothers are suffering for that.

Only takes one... My ex wife has literally said to me that she'll do anything to cause as much trouble and hardship in my life as she possibly can. She succeeded for a long time in a number of ways and the Friend of the Court helped her do it. She would do things like lie to them and tell them I was making about four times more than I actually was making and they would arbitrarily change my support amount to reflect the amount she said I made. I go in to challenge it and they wouldn't even look at my pay stubs and information. Took about eight months to get them to look at it and by then I was deep in the arrearages. When they finally did admit that the information they were given was inaccurate they refused to change the amount they said I owed. They actually charged me more in child support than I made that year... I didn't even miss paying... they just wanted more than I had to give. I've been paying that bullshiat down for ages and keep up with the payments even though my ex makes twice what my wife and I make put together right now and doesn't really need the money.

Beyond that she denied my visitations for extended periods of time and wouldn't let me even speak to my daughter. She tried convincing my daughter that I didn't love her, would say horrible and untrue things to my daughter about me constantly, and even sent her Dad and brother to my house to hassle me and my family (I have a wife and kids) on numerous occasions. None of my complaints were listened to at all by the courts and they would do absolutely nothing to help me for a very long time.

I have a really good judge now. He's fair and honest and has put a stop to the bullshiat my ex was pulling. Luckily my case stays with this judge and for now, things are going well. He literally told my ex at the last court hearing that she "could not interfere with my absolute right to have a meaningful and loving relationship" with my daughter and if she did try to cause trouble that he would immediately grant me full custody of my daughter (we have joint-legal custody). Since then, my ex has not tried to cause problems, stopped lying about everything, and I now get to see my daughter on a regular basis without interference.

Essentially... until I got a good male judge (the female judges in the past wouldn't even let me explain my side of things most of the time), I was getting screwed by the system. Things are much better now that my ex isn't given a free pass to screw me over with her every whim.

I don't mind a fair and honest child support system... I just really dislike how often it gets abused by a vindictive ex spouse who's only goal is to ruin your life.

What I meant is that the state doesn't really care about my rights, per se. They want to make sure the taxpayers aren't footing the bill for my Crotch Fruit. I get that. But if they actually cared about the childs well being, making sure the non custodial parent can at least get some kind of visitation would be nice, but that's a whole separate filing fee, lawyer fee etc...

I just want to see my kids. I already had to fight a bogus 25K "in the rears" that about broke me. Small victories, I guess.

Child support does not buy visitation in any State.  It only appears that way superficially because obligations are calculated, in part, based on how much time the child spends in each parent's custody.  That's formally determined by a visitation order that is typically granted at the same time child support is ordered. "No visitation" actually results in the highest possible child support obligation for the non-custodial parent.

If you have a visitation order, it can be enforced.  If you don't have one, you can get one (if there's no good reason to deny it).  I suggest that you find a local guardian ad litem  and ask how to go about doing whatever's needed.  Every Florida district court has a GAL Program, and you should be able to get a referral to a GAL or two through the family court clerk.

One possibility is to get  a GAL appointed for the child to represent his/her interest in visitation.  You may not have to bear the entire cost of the GAL. You can ask the court to split it between the parents or find some other way to pay it.

Good luck.  Persevere for your kids' sake!

She has an excellent sense of what others will let her get away with, unfortunately.  She also has a sense for others' susceptibility to flattery, like the honor of being chosen as godparent.  "She has no sense" underestimates her and helps her get away with more.

She wasn't in labor 7 minutes after giving birth.  Really, I don't  think a FB announcement of a birth is out of line.  The timing was logical.

We're not paying, but all of the kids are.  They may be provided for adequately, but they do not have all of the resources to which they are entitled. What your brother provides for her kids is not provided for the others. What Father 2 owes is missing. All of the kids are getting cheated.

If it's just because mom's a lazy coont, then she needs a fire lit under her ass.  Not a dime for her personal wants until she applies for child support.  Food and shelter, nothing more.

Be glad you aren't in the UK.  A divorced father has no right to see his children if his ex-wife decides to not let him see them.  No "what's best for the children" protection as with most states in the US.  He still has to pay child support.

I had a similar experience with a female judge in my divorce case (no kids, thankfully).  She pretty much took my ex's statements at face value and rejected anything I said without bothering to look at the documentation.

I know that two data points does not suggest a trend, but I'd certainly like to see some kind of statistical study on female vs. male family court judges the the perceived fairness of their rullings.

Well in WI there's two factors at play here:

1.  They automatically ding your paycheck for child support owed.  So if he "didn't have the resources" that means he was claiming he didn't have a job and was working under the table.  Or he was bouncing between jobs so often they couldn't make the paperwork stick.
2.  They'll happily throw your ass in work-release jail until you get a job and get at least reasonably caught up.  Maybe Milwaukee County can't keep up with all the deadbeat dads but the surrounding counties are decent (not great) at it.  And of course if you're in work-release you have to pay "rent" too, auto-withdrawn of course, which just means it takes longer to get caught up.

1.  They automatically ding your paycheck for child support owed.  So if he "didn't have the resources" that means he was claiming he didn't have a job and was working under the table.  Or he was bouncing between jobs so often they couldn't make the paperwork stick.
2.  They'll happily throw your ass in work-release jail until you get a job and get at least reasonably caught up.  Maybe Milwaukee County can't keep up with all the deadbeat dads but the surrounding counties are decent (not great) at it.  And of course if you're in work-release you have to pay "rent" too, auto-withdrawn of course, which just means it takes longer to get caught up.


A lot of men called "deadbeat dads" honestly can't find work or have taken a job that pays less.  The family courts don't give a shiat if you really can't make more.  Your past income is an indication of your earnings potential and they can't be bothered with unimportant things like a farked up economy and 10% unemployment.

The actual dead beats make it even more difficult for the guys who are trying their best in a bad situation.

Ah, yes, child support -- the State's way of forcing men to give women what they get out of marriage (money) without having to actually be married.

After all, modern life just wouldn't be the same if weren't reflexively assumed that women can do no wrong.

I had a similar experience with a female judge in my divorce case (no kids, thankfully).  She pretty much took my ex's statements at face value and rejected anything I said without bothering to look at the documentation.

I know that two data points does not suggest a trend, but I'd certainly like to see some kind of statistical study on female vs. male family court judges the the perceived fairness of their rullings.


I've heard from quite a few men that they got similar treatments. I too would like to see some statistical data on that. 

Another thing I would like to see (but don't expect it to happen) is accountability on the side of the person receiving the support money. Something that shows how that money was spent to ensure that it is actually being applied to the care of the child.

I don't think you are grasping the true (albeit unstated) purpose of "family law."

And I use the term "law" loosely, since there are no objective standards.

My point is, she has no sense when it comes to others. Picking two godparents? Cool, picking 22? Greedy. They all pony up and give gifts for the honor of being one of them. But my brother's already made it clear that if something happens to them, I would raise their daughter and its in his will as such. None of them would engage in a fight with me over custody either, I can promise that.

Being in labor means maybe you focus on what you're doing, not posting pictures on Facebook. That's just attention whoring.

She has an excellent sense of what others will let her get away with, unfortunately.  She also has a sense for others' susceptibility to flattery, like the honor of being chosen as godparent.  "She has no sense" underestimates her and helps her get away with more.

A birth announcement is not a mundane "detail" unless you're Octomom.  How long does it take to snap a pic and post it to FB with, "It's a boy/girl?"  How soon do you think friends and family want to know?  In the good old days, a mother would neglect her child for hours while she hand-addressed envelopes and licked stamps.

Birth announcements are one of the few valid applications for Facebook.

On those rare occasions when I have a large amount of nice cashy money, such as after a garage sale or selling some possession I no longer needed, I like to snap a picture of my cat with the funds in question. That's amusing, and on the off chance the cat drools on any of the bills, that's how I know which ones to donate to animal-rescue charities or set aside for my pets' vet care.

That and Stone Thug Mistah Clawz the Phattest Kizzizzy Kat be representin' all his peepz up in the municipal sheltah, dogs and kittiez.

The funniest part about this is that when some park ranger in Zaire saves someone from getting eaten by a lion there will be no "Was he black?" comments. It's only "was he black" when it's a shiatty American stereotype. I guess some people love it when black people fark up. Then they want to celebrate it publicly. Have fun everyone!
