A grand jury has indicted the driver accused in a fatal hit-and-run crash this month on new charges of second-degree manslaughter, the Brooklyn district attorney said on Tuesday.

The new charges are more severe than those that prosecutors had leveled against the driver,.......

SDRR: Scott Brettschneider, a lawyer representing Mr. Acevedo, said he would analyze the speed and traffic data at the time of the crash, as well as the behavior of the cabdriver as he entered Kent Avenue from Wilson Street, where there is a stop sign.

"Somebody needs to scrutinize what this livery cabdriver did and didn't do," he said.


And lawyers wonder why everyone (besides their mothers and most of their spouses) hates them.


So if there is evidence that the cab driver blew through a stop sign, contributing to the collision we should ignore it and lay all of the blame on one person?

That doesn't mean Acevedo is innocent of any wrong but it seems like that could be the difference between years in prison and decades in prison for his client.

Smelly Pirate Hooker: I don't know why we don't send everybody who kills someone with a car to prison. Unless your car is forced into another vehicle (or person) by being hit by still another vehicle, dead people are just as dead regardless of whether you pointed a gun at them or killed them with a car.

I don't give a fark about intent. When you demonstrate enough negligence and it kills someone, you're guilty of causing their death. It's only an "accident" in the sense that you didn't seek them out, floor the accelerator and run them over because of some grievance.

Maybe people would take driving more seriously if we'd punish the results of not taking it seriously more harshly. Maybe stop putting junkies and hookers in jail and start putting those who recklessly disregard other people's safety in their place.


So much this, there are no "accidents" on the road, only negligence and incompetence.  We really need to treat a drivers license like the responsibility and privilege it is, rather than a right.

Yeah, not really sure what that has to do with anything. It's much more relevant that the driver has past felony convictions.

I've always agreed with the Germans on this. Get caught driving drunk? Automatic 30 days in jail AND you loose your licence forever. Driving is a privilege; not a right.
