I guess they've ruled this a homocide?  Every fiber of my being is screaming this guy was murdered -- you don't end up in a pile of recycled paper with a broken leg and facial fractures by accident.

You're assuming he had the broken leg and facial fractures before the trash compacter got through with him. He could have been some homeless guy catching a nap in a dumpster. Or died of natural causes and somebody freaked and tossed the body in the trash.

As I recall, a few CSI and L&O victims ended up in the trash/recycling, does anyone remember the eps?

Also, there was a 70s movie about a cop whose wife was killed and he entered the priesthood.  A cop who was assigned to work on his wife's shooting was actually with the mob, which killed him by pushing him onto a conveyor belt carrying trash to a compactor or incinerator and shooting him in the leg so he couldn't jump off. - Bonus points to anyone who remembers the title of that one!

If she ruled it a HOMICIDE, did she happen to share any more detail with you as to why she came to that conclusion?

I don't know, but I definitely don't think they go with paper. I mean, if you can't put pizza boxes in there because of the leftover cheese I'm sure a corpse would be right out.

It's automatically a homicide if it's not by natural causes or obvious suicide. Homicide isn't a criminal definition.

What if is accidental? I wouldn't qualify that under natural causes or homicide.

Homicide means a person caused another person's death. It can be accidental or intentional.

If someone is arrested, the crime (where I live) would be murder or manslaughter or reckless homicide.

Homicide is the death of a human being caused by another human being. The next question is then whether the actual cause was negligent, intentional, justifiable or malicious. An "accident" doesn't exist in legal terms--it's negligent, the only question after that being degree of negligence.

You'll notice that a legal execution is still a homicide--it's a justifiable homicide, as is self-defense. But if you get killed by the neighbor's pit bull, then it cannot be homicide, no matter how much you want to make it one.

To clarify, I didn't mean accidental by means of another person. For example, someone who is on the roof cleaning their gutters then falls to their death. That would neither qualify as homicide or suicide. It was in response to this:

dj_bigbird: It's automatically a homicide if it's not by natural causes or obvious suicide. Homicide isn't a criminal definition.

However, now that it is morning and I am coherent (it was almost 2:30am when I responded, and my sleepy meds were kicking in), I realize now by reading what this person was responding to that my question took this statement completely out of context LOL. Sorry about that!
