Chapter 1 of Title 4 of the U.S. Code establishes advisory rules for display and care of the flag.  It's a federal law, but one without punitive measures for failing to comply with it.

Per this law, only the President, state governors, or the mayor of Washington DC can order half-masting of the flag.  But lowering it in this instance is speech covered by the 1st amendment.  Still a dick move IMO, but what are ya gonna do?  That's why the 1st amendment kicks ass.

It seems Presidential authorization is not explicitly required.

"In the event of the death of other officials, former officials, or foreign dignitaries, the flag of the United States shall be displayed at half-staff in accordance with such orders or instructions as may be issued by or at the direction of the President, or in accordance with recognized customs or practices not inconsistent with law."

Seems open to interpretation.

Ironically republicans violate the flag code on a more daily basis than anyone else simply by putting it on everything.  Which is strictly prohibited.

I am not a flag-waving patriot by any stretch of the imagination, but even I find it ridiculous that a company would do something like this. Why would anyone think that lowering a country's flag to half mast over the death of another country's leader was OK?

My lazy ass hasn't read through all the comments. I'm sure this has been said, but that gesture by Chavez is the same as the neighborhood mafia setting off nice fireworks for everyone every year, or helping the old lady out who can't pay her rent. Its done soley to buy influence and make it look as if he's a great guy..

Don't fall for it..it costs him next to nothing, and yet buys him good will in his perceived enemies domain.

Because, as was stated earlier if you'd bothered to read, one international flag shouldn't be flown higher than a different one. The headquarters flies a Venezuelan flag as they are a Venezuelan company, so when they dropped that flag to half mast for the death of their leader, they dropped the American flag as well so they were at equal heights.

That is correct, although I do disagree with them lowering the US flag in this instance.  I think they should have just lowered the Venezuelan flag and left it at that.

Can we start a side-thread about whether or not that convention should change?  I think it cheapens the gesture of Venezuela's flag being half mast if the US flag, which is theoretically at full mast, is flying at the same height as it.  Half is half.

I say the international convention should revolve around the height of the poles, and each flag can then follow its own conventions relative to space defined by its pole.

Necronic: Honestly this just emblifies what is good about our country.  We allow this kind of stuff.  Makes me happy to see, because it's a large part of why we do so well.  We don't care who you are or where you're from (for the most part), if you can make money, come and do it here.


I had to think about that for a bit, but I agree. Now, on a social level, I really wish we could we could talk honestly about things that impact us on a financial basis without inflammatory sound bites that are just designed to get views and people yelling, "herp derp DEMS" and herp derp CONS".

This "for us or against us" mentality has to end soon. Sadly, I don't see it happening. These assholes in Congress have built their little kingdoms, and they live on conflict, divide and conquer. They say what their constituents want to hear, rather than addressing actual problems, so they can build a war chest for the next election. They're not working for us, they're working for themselves.

I realize that this is how it's always been, but the politicians are so transparent about it now, it's sickening. Nobody in Congress gives a shiat about the little guy, whether he/she is DEM or GOP.

Umm, no.  The flag code says that no OTHER flag can be higher than the American flag - they can all be lower.

"No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations."
