Well, this was in vancouver, and the fact that he even felt a need to mention it is odd... Definitely points out that, even legalized, they haven't gotten their laws down.

In fact, I'm not sure what jurisdiction the officer would have had to open the trunk...

Cop: "I smell marijuana"
Driver: "Yeah, I have some in the back.  Its legal now."
Cop: "Uhhh, how much do you have?"

I don't get it.

On a side note, the way I see it, if you're illicitly carrying something, say in GA, and the cop smells it, you can either say "no" to the cop and (as someone mentioned) wait for the dogs, or have the car impounded, and wait till they open it and you're behind bars.

As soon as you're stopped, and the cops are asking, you're screwed.

No it goddamn doesn't. How stupid are you that you don't see the logical fallacy? If you were to exercise your Fourth Amendment right to refuse a search without probable cause, and that refusal in itself constituted probable cause, then why does the Fourth Amendment even exist? This idiocy is mind-boggling.

And then they call in the dogs, which have just been recently ruled by the Supreme Court to be infallible (even if they give a false positive, whether by accident or on command).

And if the cops are feeling really ornery, they can use the dog's (false?) positive as reason to believe there's a non-zero chance that your car may have had illegal drugs in it at some point in history; that reasoning could then be used to justify the seizure by police of all your worldly possessions (car, house, all funds in bank account, etc) except the clothes on your back with absolutely no recourse or due process whatsoever for you.

All this over a plant that's more abundant than than most trees and less toxic than water.

Few people understand the psychology of dealing with a highway traffic cop. A normal speeder will panic and immediately pull over to the side. This is wrong. It arouses contempt in the cop heart. Make the bastard chase you. He will follow. But he won't know what to make of your blinker signal that says you are about to turn right. This is to let him know you're pulling off for a proper place to talk. It will take him a moment to realize that he's about to make a 180 degree turn at speed, but you will be ready for it. Brace for the g's, and fast heel-toe work.
