Let the court decide the amount of monthly child support is appropriate, then require the sperm bank to pay that amount  so that not a dime comes out of the unwitting father's pocket and the child doesn't have to suffer either.

Charge the sperm bank with human trafficking and the clinic with receiving stolen goods.

BumpInTheNight: So when a man forces a woman into a pregnancy its a ... but when a woman forces a man into a pregnancy its a ...

Are we talking about IVF in both cases of "forcing into a pregnancy"?

I ask because I want to know which flavor of stupidity I'm dealing with.

FarketyFarkerson: Another article says they broke up in 2011 and the child is now two years old. Sounds possible the guy had a change of heart about having a child with her after she was already pregnant. Something doesn't add up here.

It's journalist math. Things get rounded both ways so often that at the end of the article nothing adds up. Rounding up 1 = 2 for a sufficiently large value of 1.

Just make a rule that any "withdrawal" of a non-anonymous sample requires the presence of the donor and photo ID, or the notarized death certificate of said donor. Is that so hard?

BarkingUnicorn: Xythero: "Bernsen, who represented both Hardin and LeBlanc, said the couple signed a contract with a sperm bank giving any future access to the sperm solely to LeBlanc if she decided to conceive another child. "

That is why you fail.

I can't believe that's accurate.  Future access for LeBlanc after Hardin is dead, maybe.  Require Hardin's death certificate to withdraw sperm.

Regardless, LeBlanc is not the woman who withdrew the sperm; that's Devall.

Yes.  Took me a minute to grist that from the article.

For the rest of you, here's a basic run-down of what happened:

1) Hardin and LeBlanc get married
2) Hardin and LeBlanc have a child, decide they don't want any more kids
3) Hardin has sperm stored at a sperm bank, giving LeBlanc exclusive access to it
4) Hardin gets a vasectomy
5) Several years later, Hardin and LeBlanc divorce
6) Several years after that, Hardin starts dating someone named Devall
7) Biatch be crazy, Hardin breaks up with Devall
8) Devall goes into the sperm bank where Hardin's sperm is stored, somehow obtains it despite her name not being "LeBlanc"
9) Devall literally goes next door and gets impregnated with Hardin's sperm

The important part here is that there is no other way Devall could have gotten pregnant.  The vasectomy was done a decade before her kid popped out, and it's easy as hell to test if a vasectomy has reversed itself or not.  Unless she managed to jab a syringe into his balls while he wasn't looking, she had to get the sperm from that sperm bank.

grimlock1972: yeah that sperm bank is pretty well screwed and is likely to be sued out of business.

Don't want it out of business, want it paying child support.

onyxruby: Depending on the state he can be held liable for child support. Develop a relationship with the child even though you went through a sperm bank? That alone is enough in many states to be held liable for child support. Have a written contract, trying to help out a lesbian couple or other such situation? Your still held liable in many states for child support. Since your not married you will also discover that you have no rights to the child, only the 'responsibility' of paying.

Dollar for dollar it's a far better payout than the average lottery payout ($100,000) for the mother since it is tax free and their is no expectation that the money is spent on the child. Now that your starting to see women being held child support (and alimony in some states) you may start to see some reform of these laws.

You have to be very careful to make sure you only donate to a currently licensed sperm bank and even then only in a state with protections for the father. The laws vary from one state to another by quite a bit so you have to look it up in each state. It's not at all like driving where the laws are generally similar to each other.

Women have reproductive rights. Men have reproductive responsibilities. Waiting for women who claim they want equality to accept the same responibilities as men or grant men the same rights they have.

Twice, it seems.  Maybe thrice, depending on the sperm bank's collection method.

This is why trials need to hurry up (if somehow possible) and get completed on that polymer based male contraceptive to see if it's truly safe or not. It would have been a way to avoid this since he would have never needed to bank anything (reverse the procedure, donate, re-apply) and couldn't have had the crazy ex steal/sabotage anything since it's inside the body.

Hum this is a case of the mother deciding to hit the sperm donor up for cash without his consent.  I don't really see this as his fault.
