Martinez said he didn't know why McKee was being chased but he joined in. And when he could not stop Mckee who entered his car to get away, Martinez pulled out his 9 mm handgun, Sampsell said.

... well, I for one feel safer now that this guy is gonna have a criminal conviction on his record and won't be allowed to carry a gun ever again.

Is there any way we can get him banned from operating cars and heavy equipment while we're at it?

Eh, I'll almost defend him, there are angles that risk less injury to bystanders. And trying to help guard/police should mitigate.

But I doubt he fired carefully.

No... Just no. The thing that they spent the most time on during my CCW training was when you could shoot and when you could not shoot. The shooters life was not in danger and neither was anyone elses until the dumbass started shooting.

Bahahahaha

Hey guys, you NEVER see a concealed carrier acting recklessly. Just try to find me some examples you can't! In your face, coward libs.

Well, I dunno about FL, but Texas actually directed its police regulatory organization to keep track of convictions for CCP holders and compare them to convictions for the general population.

While they're not perfect saints or anything, generally speaking CCP holders commit an order of magnitude fewer crimes than the general population at most.

Here's 2011's report:   http://www.txdps.state.tx.us/RSD/CHL/Reports/ConvictionRatesReport201 1 .pdf

For reference, there are 450k to 500k licensed carriers in Texas, and TX has a population of about 15 million that's over 18 (couldn't find the number over 21, which is the actual demographic allowed to get a license.  So a proportional crime rate for CCP holders would in this case be about 3%, give or take some rounding.

Again, this is TX, not Florida, but statistically CCP folk are in fact a significantly smaller crime risk than the general population.

//Obviously, the exceptions are "unlawful carry by a licensed carrier", which you can't really commit without being licensed.

I have a dream most nights. It starts on a playground. There's kids swinging, laughing, dogs barking, butterflies just flapping their little wings. And then you hear a rumbling, and over the horizon comes a black cloud and it's made of cancer and pus. And it starts sweeping over the playground and everyone starts screaming and clawing their eyes and pulling at their hair, and saying "Help! What do we do?" And you know what happens next? Out steps me wielding the biggest farking shotgun you've ever seen in your whole life. And you know what I do? I blow every farking thing away. And I am getting God's work done. When it's all over and the dust has settled, the whole world gathers below me and they say, "Thank you, Ronnie, thank you for helping, being a great man and doing this for us." And you know what I say? "You don't need to thank me. I'm just a guy with a gun. I'm just a cop."

Um, that'd be a no.  Saw that on the news last night and when they said he was facing felony charges, I said "good".

Of course, I'm one of the traitorous pro-gunners who doesn't have a problem with more extensive background checks and licensing.  I would also love a written test to be added to the concealed handgun course that had questions similar to this situation.  "Is Jose justified in firing off rounds into Eddie's car as he flees?"  If you don't pass the farking test, you don't get the license.

Question 2: You see a man in a parking lot shooting at a car traveling away from him. Do you:

A) draw your weapon and fire at the car?
B) draw your weapon and fire at the shooter?
C) draw your weapon and ask the shooter why he's firing at the car?
D) start to wonder why either of you is carrying a gun?

He was going for his hero tag, but forgot which state he lives in.

It seems there are a lot of people out there who want their "citizens arrest" cred for running down a shoplifter. They forget that the law still applies to them and assault, property damage and in this case weapons charges could easily be avoided by INFORMING the authorities rather than trying to become them. A witness is invaluable whereas an assailant means more paperwork.

This is part of the reason Cali doesn't recognize CCWs from any other state. You could have a CCW for any other state - or all of 'em that have them - and still wind up being charged in Cali. Well, charged or shot. You've surely noticed by now our cops like to shoot things (if they can hit them).

Elegy: PapaChester: How the hell did this dumbshiat receive a CCW permit? Does Florida just give them to anyone that asks for one? What the hell is wrong with the south?

Yes, Florida gives them out to anyone. As a Florida resident, I can tell you that the process involves:
A) taking a class
B) filling out a form
C) sending in your paperwork along with a $120 check.

As far as the class goes, you can use the state-mandated hunter safety classes to meet that requirement. The class I took when I got my hunting license was about 6 hours of online lessons and testing - most of it centered around how to properly identify legal game - and a 4 hour classroom.

During the classroom component, I was required to fire two weapons - one shot from a .22 and one shell from a 12ga. Concealed carry was discussed not at all, other than the instructor telling us we could use the course to meet the requirement for a concealed carry permit.

So now you know.

The CCW permit class is approximately as useful.  It's basically two hours of them going over the law, dumbed down to the 8th grade level necessary so that most people can "understand" it.  This is, in all likelihood, one of the reasons we have issues like this.  If you insisted that people be intelligent enough to be able to actually read and understand the statute itself, it would eliminate about 80% of potential permitholders.  A psychological test might be nice, too.  Weed out the people who test particularly high on Psychoticism, Aggression, and low self-control.

Oh, and in Florida's pretend CCW class you have to show "proficiency" with a weapon to get your CCW.  For my class, I had to shoot five rounds out of a Ruger Mark I.  A gun with zero concealableness to speak of, and pretty completely different than my carry gun (at that time a Glock 26).  We didn't have to hit the target.  Well, OK, we had to hit somewhere on the big sheet of paper.  But it wasn't necessary to hit the actual target rings.  Nor was there any need to show ability to draw from concealment.  Or effectively holster a weapon IN concealment.  In short, the course was complete bullshiat.

I really wouldn't mind it if Florida went and totally rewrote the CCW statute.  I believe in the concept of "shall issue", but it needs to be contingent on passing a bit more of a test than what they currently have.  If we weeded out even a tenth of the really stupid, seriously aggressive, or just plain deranged folks, I figure we'd reduce the number of CCW "incidents" down even lower than the rate they currently are.
