It's a photo of a photo on the wall. I think that'd fall under a fair use clause of some sort. Madonna is a collector of Kahlo's art.

As Oscar Wilde said, "There is no such thing as bad publicity". Way for Instagram to get some attention and possibly new users/subscribers.
