He walked all daylight hours, talking loudly, quoting baseball statistics and history.
He was difficult to engage, but if you were fast and knowledgeable enough, you could get him conversing.
Covered a period of almost 10 years and just disappeared one day.

I do not see it that way.  He was annoying the hundreds of people within a one block radius around him...this is no different than loud sub woofers.  I am more than certain that the cops have been called on this guy multiple times, and that they have had many words (perhaps not as many as the linked, unnecessarily long article)...he refused to stop and the cops did something about it.

It's not my place to dictate to another person my own personal tastes. Up to the point that the sound can cause some sort of harm (hearing damage or impairing the ability of other drivers to sirens, horns or other necessary indicators one requires to hear while driving) it's up to the individual to choose how to behave, and I have to tolerate it. Annoyance is not harm. Some people might be annoyed by "dem queers" marrying, but that is NOT grounds for denying them rights. "I don't like it, it bothers me" is never a good basis for a law.

Maybe we should ban fat people from wearing "sexy" clothing because it's bad for business when other people have to see their disgusting bodies molded into clothing that is designed for someone half their size? That cannot be good for an eatery, now can it? Oh, and while we are at it, cross-dressers have to go too, because obviously children shouldn't be exposed to their perversions. People with deformities, cripples and midgets are just... eww... so let's make sure no business has to suffer the loss of customers who are put off by the presence of such... creatures. I do not see it that way.  He was annoying the hundreds of people within a one block radius around him...this is no different than loud sub woofers.  I am more than certain that the cops have been called on this guy multiple times, and that they have had many words (perhaps not as many as the linked, unnecessarily long article)...he refused to stop and the cops did something about it.


He's been ticketed and fined 4 times. No effect.

There's a mildly mentally handicapped guy in my neighbourhood who screams out the lyrics to the songs he's listening to on his portable cd player.  I know its a cd player because one day he got mad at it, pulled the cd out, threw it down the street and yelled at it for about a minute.  Occasionally I see cds laying on the street, the sidewalk, or the grass.  I assume they're his and they pissed him off someway.

Anyways...back on track....so he screams (and I mean SCREAMS) out the lyrics to whatever song is playing (either on the headphones or in his own head).   The looks on the faces of the people on the street and at the bus stop where he waits for the bus are priceless when he really gets going.  I've watched women go running down the street to get away from him.  He's harmless, I've seen him for years now out there singing his songs but I laugh every time I hear him coming.

So the guy is standing where he's been asked to leave, whistling as loudly as he can in a monotone (not some happy-go-lucky tune, but just a single note, as loud as he can, constantly), because God told him to.  After repeatedly asking him to leave, or repeatedly asking him to stop following them and whistling loudly at them, businesses and citizens have reported him to the police.  Because the normal ways you deal with adults (asking them to stop) were ineffective.  The police have taken the steps the law allows, first talking to him, then citing him, then putting him before the magistrate... and the guy keeps up his disturbing whistling and purposefully Annoying for Jesus.  Finally, the only solution is jail.  Which, by the way, isn't stopping him either.

Replace "whistling" with "blowing a goddamn air horn", and you may be less likely to defend the guy.

Personally, I think he should be referred for psychiatric evaluation.  He's obviously incapable of understanding civility, and may also be incapable of understanding morality.  One day, he may snap and decide to strangle the lady he's following and whistling at.  Society should help him.  Perhaps he deserves the same quality care that our schoolchildren get - drug his ass until he doesn't feel like whistling any more.

Or, as someone else, mentioned, place him in for a 72-hour evaluation and perhaps he'll trip down a flight of stairs and fark up his mouth enough that he won't be able to keep it up any more.

anyone who has not experienced this man's whistle... you don't have any clue. it is far worse than is described. it is monotone, in random bursts, slightly off-key. you can hear him from a good thousand feet away. now. imagine standing next to this guy at a bus stop. after 5 minutes, maybe you ask him to stop. he tells you "God told me I can whistle as much as I want, so I'm gonna whistle as much as i want." and keeps right on whistling. it now seems louder, as if that were somehow possible. this goes on for another 5 or 10 minutes, and the bus arrives. mind you, this is the only route on this stop. if he was waiting for the bus, this is the bus. he doesn't get on. there is nothing around this bus stop he could be hanging around without it being considered loitering. this asshat is just doing it to see how many people he can piss off, and using Jesus as a shield.

I had a small amount of sympathy for the guy while reading the story.

Then I played the video, and thought, "F that idiot. He's not whistling a song. He sounds like a dying pigeon."

I do not see it that way.  He was annoying the hundreds of people within a one block radius around him...this is no different than loud sub woofers.  I am more than certain that the cops have been called on this guy multiple times, and that they have had many words (perhaps not as many as the linked, unnecessarily long article)...he refused to stop and the cops did something about it.

If you ever visit Portland ME. This would be the highlight of the visit. Even when the sun shine they are the most clinically  depressed lot of people I have ever met. He sounds some what happy must stop him.

If he is on his own private property or public roads, yeah... I would. If he commits criminal trespassing as you described above, then he is in violation of the law and I would act accordingly.

I live in an agricultural area and often times there are loud noises at all hours of the early morning, from helicopters doing spraying to old-ass tractors driving by. We have heavy machinery, all manner of smells from manure and mulch piles and radios blaring out mariachi music all throughout the day. Burn piles and smudge pots fill the air with smoke that tastes terrible. Big-rig trucks honk at 3AM to get someone from the nursery next door to roll up the door, sometimes laying on the horn for up to ten seconds or so.

It's just part of life. It's loud, smelly and unpleasant at times. That doesn't make it criminal. If someone is committing harassing behavior like following you for miles on end and essentially stalking you, that is a different matter entirely from someone walking down the street with a loud boom-box blasting music I just can't stand. Just because I don't like it doesn't mean he needs to stop. I've been in a park where people are biatching about the smell of the BBQ making them feel sick because they are began and burning meat is offensive to them. Should that be criminal, in your opinion? Should they be "denied" the right to enjoy the park because of it? If not, then what about a cigarette smoker at the park? Where do you personally draw the line, and why?
