I've never understood "resisting arrest" charges, especially when there's no other charges to originate the arrest.

I hadn't heard about him in a few years so I took a look at his wiki bio. He's been married for 27 years. He has a whole bunch of business ventures going on which must keep him busy. From what I remember, he always seemed like a grounded and humble man, even at the height of his fame. I'm going to side with him on this one. I really don't think he's a troublemaker.

Yeah, I'm going to side with Hammer on this.  If the Police Department had a legit statement to give the press, I would have had some doubts, but the "We sometimes patrol that area" is such a red-flag-waving non-statement that I can't honestly believe the "arresting" officer was actually doing his job and not just hoping to nab himself a quick probation offender.  Hammer has quite publically cleaned up his act after all that early 90's Parachute Pant money dried up and he alienated everyone that ever mattered to him.  If they had made mention of him running a stop sign or, you know, actually committing some kind of crime, then I would be waiting until both sides of the story have come out.  But if all they did was arrest him for being there and not being happy about being arrested, then I call bullshiat because he SHOULD be not happy about being arrested since he WASN'T DOING ANYTHING WRONG.  I'm not a "fark tha Police" kind of Farker, but I also don't believe the cops have the right to ruin your day with the cop version of "I'm not touching you, I'm not touching you, I'm not touching you, If you touch me you're under arrested, I'm not touching you!!!".

Not a fan oh hammer, but I'm siding with him on this. Dublin police seem to suffer from bored cop syndrome. This is a rather nice upscale community that doesn't have much of a crime problem, but I have seen several stories about the police busting hookers in some of the local hotels.  Fun work if you can get it I guess.

This is my town.  The cops here aren't normally douchey, but any time someone is arrested for "resisting arrest', I assume the cops are making up any damn excuse they can to arrest.

No.  I live here.  They don't normally harass someone just for being black.  At Hacienda Crossing they tend to keep a close watch on teenagers since it's their local gathering place, but they do that regardless of race.  However, it's possible there's a bad cop in the bunch that needs to be dealt with.  MC is a standup guy who doesn't have a history of being a troublemaker.

Cops can arrest you for no reason and hold you for up to 24 hours without charging you. Yes, they *might* get sanctioned for it later if you complain and they do it to you too often. But that's the sad reality of life. When you are arrested and you don't co-operate, that is resisting arrest. You have now gone from being in the right to being in the wrong. The better option is to ask if you are under arrest, and if you are, shut up and let it happen. Then, they will either charge you with a crime or let you go after 24 hours. This is just based on my own experience with the legal system and shouldn't be taken as legal advice.

ive known peopel who were arrested only to have charges dropped who spent a few days inside because they were too broke to post bail and didnt get their prelim hearing for a few days for whatever reason

There's a difference between catching a BS charge and never being charged. They can't hold you more than 24 hours without at least filing a charge against you, though (technically there are sneaky things they can do but usually won't). Now, they can charge you with BS and make you wait over the weekend to see a judge, who'll drop the charges. But I'd imagine you'd really have to piss a cop off before he'd do that. My own experience was they waited the full 24 to charge me, and then finally went ahead and did. It got dropped later but they really thought at the time that it was righteous.
