The article is quite screwed up. It makes it look like the court was being a dick, when California Statutes state that if you raise it, it's yours, no matter what the DNA test says - and fraud by the cnut has zero to do with it.

IMO, he's pissing money away on lawyers when he could be paying his child support with the cash.

I hope he sues her for fraud. He has 3 years from the occurrence of fraud or discovery of the fraud to sue. He won't be able to get out of child support, but he should get every dollar he spent on their wedding and every dollar she took to pay for her personal bills back. IANAL, though, and I don't hold out hope for that.

I'd like to hope that if I had a father/son relationship with somebody for 6 years, I'd be ok continuing that relationship even after finding out he wasn't mine.

The court didn't look like a dick to me, the article laid out that their hands are tied because of a stupid law.  The judge seemed to be very much on dude's side and probably would have loved nothing more than to tar and feather the ex.  But he has to follow the law...

He should be able to make some sort of argument that the deployed time shouldn't count against the time frame needed to make a claim as there was nothing he could do at that point.  He should.This being a family court & in particular a California family court, his being male is all the evidence needed of being completely guilty of most everything the opposing lawyer can come up with.

That's a good idea.  It may not make much of a dent in the total amount of child support he has to pay over the years.  I'm pretty sure it will hurt her tremendously as she sounds like the type to spend everything the instant in comes in.

Same advice I gave my Marines.  Apparently, this guy didn't listen to his safety briefs.  To those girls, you're a way out of town, with a steady paycheck, and you won't be around as much as others.  And never, ever trust a girl who says she's on BC, so you don't need a condom, honest.

Pretty much. I got stationed in Fort Riley, Kansas with the Big Red One. If you were a local girl who couldn't afford college, your only options in the glamour of Junction City, Kansas were Wal-Mart cashier or Denny's waitress.

Or get knocked up to a soldier. You'd think after the first three or four guys got stuck with a teenage bride, our guys would stop believing the "we don't need condoms, I'm on the pill" line.

i've known at least 10 young guys who joined the military and had their wife, fiancee or live in girlfriend screw them over royally. drugs, farking other guys, ruining the guys credit and taking off with the new car, claiming he was abusing her and getting the guy shafted, you name it. maybe a lot of young women who are attracted to uniforms are idiots, i don't know.

If I were him I would pay the child support, for now.

But I would also take this story public, I would contact as many news orgs  as I could, start my own Facebook group about it, make sure her name, pictures, and actions get out there as much as possible, I would even write a book about it. Everything I possibly could to warn the public about this person.

Maybe start a veterans support group for men And women who were farked over by their SOs while on deployment.

No it was set up to protect women in a time when they were as a social class Legitimately disadvantaged and in need of support, that time has LONG since passed. The laws need to be Re-examined, and changed to better represent the times.

Don;t know if you know this, but a paternity test ban was upheld in France.  ..  Any paternity testing without a court order is banned, due to fears that more families could be broken by divorce if all fathers were given access to them.

in the comments section at the link there is a comment to the effect that florida, and perhaps other states, are re-phrasing their laws to make them gender-neutral. one small, very necessary step.

I have a friend who was married to a lawyer. She left him and, as she tried to back out of the driveway with the baby, he leaped behind the car and wouldn't move. So she tapped the gas, he moved, she left, and he had her arrested for attempted murder. For the next 15 years he used his spare time (of which he had plenty--he was a terrible lawyer and lost his license) and his dad's spare money to harass her through the courts. He maintained fake addresses in distant states in order to oblige her to fly across the country to defend herself. He refused to pay child support or alimony. His daughter is now completely estranged from him (he didn't think his cunning plan through) and his father got tired of losing and shelling out dough, so there haven't been any court cases for the last three or four years. Meanwhile, my friend is hundreds of thousand of dollars in debt. One day, about ten years in,  I said to her "You know, if you'd just run him over that first day, you'd be getting out of jail about now." Everyone would have been happier, even him, if he'd just died that day.

You know this is a strawman, right? I've never seen people excusing abuse towards women that wasn't flamed to death by the vast majority of posters.

Family court operates under the directive that the needs of the kid trump all other considerations. Unfortunately for men, the kid needs money and mommy isn't obligated to provide that money if there's a "daddy" on the paperwork. This works to the benefit of women in almost every case.

His best bet is proving her an unfit mother and getting the kid taken away. Unfortunately he'd have to provide for the kid directly. But ultimately with this type of woman, it'd be for the best. The kid is a meal ticket to her. I've seen it happen over and over again. The child support provides for her primarily and the kid gets the scraps.
