(National Post)   If you work at a beer store, find a vodka bottle filled with wiper fluid, drink it over the course of two days, and then die, hey, it's your employers fault not yours. O Canada   (news.nationalpost.com) divider line 15

Article makes it sound like employees knowingly put the fluid in the vodak bottle, and without labeling with the appropriate WHMIS tag, which is the job of management to make sure they understand why the why and how of doing this

/I have little sympathy for the victim, but I am not surprised by the ruling

Why the asinine label? This is negligence. Why on earth was there a practice of putting washer fluid in vodka bottles? Too cheap to get some properly labeled bottles I suppose. Yeah, companies will regulate themselves. And why put any money into education? If you are stupid enough to have a blue - collar job, you deserve to die.

Anybody who steals shiat, drinks the shiat, and dies because the shiat is poison... well, we are probably better off without him.  Sorry for his family/friends, but I have no sympathy for him.

Elmo Jones: Last time I checked, vodak wasn't blue.

Who knows with all the flavored ones around these days.

Anyway, the basic issue is putting poison in a food container.  That creates a hazard.

Anybody with any legal knowledge know that this is pretty standard example of negligence and vicarious liability. If you don't know what that mean, look it up on wikipedia.

It was here:

Found behind the seat of a truck, the still-labeled bottle was there due to a since-discontinued practice of Beer Store truck drivers taking empty liquor bottles and filling them with windshield washer fluid dispensed from a large vat. (Why Canadian reporters write in passive tense waits for another injunction, I guess)

So the employer was negligent in not reminding everyone to throw out their liquor bottles full of wiper fluid and replace them with actual bottles of clearly labeled Windex or whatever; and the employer probably didn't appeal because inevitably they were going to have to answer the question: "Why were you even doing that in the first place?"

As to why the guy would keep drinking the stuff: I just learned to my horror (via NatGeo Channel) that people will even drink hair spray to get drunk if they have nothing else, and the only thing worse tasting than hair spray is nail polish. So probably Windex tastes just lovely. [shudder]

looks like the WHMIS tag is the same as an MSDS label so yeah. we got fined for not having secondary cans labeled. paint cans. like anyone would chug down a little just to see how it went. but once fined you have to be extra diligent because another violation is "willful" and those cost.

Yeah.  To me it sounds like the guy was a farkin' idiot, and everyone knew it, but Brewers Retail decided they'd look like a buncha dicks if they fought it, so they just rolled over.  Good on 'em.

Ditto.  Except I have no sympathy for the victim.  I'm no expert on the taste of cleaning products but would't windshield washing fluid taste terrible?  Why would he keep drinking it?

Ya gotta label that shiat because you never know when someone's going to come along and find one of your re-purposed containers.  Last year, I was doing laundry in my grandpa's old house and needed some stain remover.  Opened the cabinet above the washer and there was a spray bottle of Shout.  Well, not really.  I sprayed my shirt with glass cleaner.  I'm lucky it wasn't bleach or something that would have ruined the shirt.
