At least almost every police department in America, LAPD included, can throw your ass in jail for blowing a .01 if they think you're impaired, but their union contract says they're above the law.

I believe that there should be graduated penalties. Blackout-drunk and tipsy are treated as the same offense most places.

I avoid driving after drinking, and no one should drive while intoxicated, but the laws are still crap.

Cops just checked us for hard drugs and guns

No, the contract says that these cops can not be disciplined for having a BAC less than .05. It does not say that officers with a BAC of less than .05 but higher than .00 will be allowed on the street.

Don't even start. Almost thirty years ago: me, some of my friends, and some people who weren't my friends were all off campus in a field indulging in our various substances. All of a sudden most of the people (kids) there took off running. It was then that I noticed that there were a couple of LEOs standing among us. One looked at me and a couple of friends that hadn't run off. He said something like, "if you drop your stuff (he didn't use the word 'stuff') on the ground the we can't get you for possession." Well, we dropped everything we had in our hands. He then picked up the couple of bags of MJ that we had dropped. He said something like, "don't let me catch you again." and walked off with our grass.

A couple of years later I was riding in a friend's van on my way to work. We pulled up to a stop light. When I looked over to my right I saw a police car. While I was watching, the passenger looked around and picked up a cop hat from the middle of the front seat. Underneath was a bong. He took a hit and passed it to the driver. The driver got a small hit before the light changed. He handed it back to the passenger, who put the bong back in the middle and covered it up with the cop hat.

Due to a typo in my employee's handbook, I can work with a BAC of .8 without risk of being fired... and I work at a chemical plant.

4 years ago I was at a medical clinic for a pre-employment drug test.  While waiting in the room I noticed a sheet a paper tacked on the wall by the sink with the title "Fire department drug testing procedure."

The procedure was basically: Fireman gets ordered to submit to a drug test. Fireman collects 2 days of urine in a clean container. Fireman brings container in to clinic.  Lab tech collects a small sample from the jug-o-pee and discards the rest.

No room for cheating there...

Chicago cops don't initiate a nationwide manhunt then push you inside a cabin when you try to surrender and shoot you in the head then burn the whole thing down and plant a wallet on you just so they can keep from having to pay damages to the family of a mentally disabled man who was beaten in a training exercise.

Chi-town may be drunks, but they don't go there.

The Chicago Police Department sets its blood alcohol limit at .02. This week, the City of Chicago agreed to a $4.1 million settlement, payable to the family of a man shot by a police officer who reportedly had been drinking prior to his shift.

Was that wrong? Should I not have done that?

Westchester is not alone. Police in Forest Park, Glendale Heights, and South Barrington also have a limit of .05. In Elmwood Park and Oak Park, the limit is the state definition of legally drunk: .08 or higher.

In Minnesota you lose your concealed carry permit if you are above .04 while carrying.  I thought that was generous.

I just wish their "Forward Thinking" of allowing people to have a glass of wine with dinner was forwarded on to the rest of us.

Your statement is as false as theirs. Alcohol impairment based on consumption is highly subjective and based on a huge variety of factors from weight to genetics.

For these reason it should have never been used as a measure of actual impairment. But, using the same type of unfounded hyperbole as MADD does no one any good.

Pretty much this.  The standard for most professions that have an BAC standard is 0.04 (truck drivers, licensed mariners, etc).  You'd hope the people who may have to make split-second decisions that could affect life and limb to be of clear mind when doing so.  You'd hope.  Plus, it's really not too much to ask.  If you can't get through your day without drinking, perhaps you should seek a more appropriate line of work instead of whining like a biatch about it.

Imagine this scenario:

You're the town attorney. One of the officers on the police force has shot someone and the investigation has led to some serious questions on whether or not he should have. If the blood and/or Breathalyzer test shows .04 BAC, are you gonna trust that officer's judgement, sensory perception, and physical coordination at the time of the shooting? You think that the lawyer(s) suing the town don't smell blood in the water? That officer's decision to drink before work could cost your town millions, and leave people dead and injured. Even if he's okay to drive.

I really don't like cops, and I don't trust them as far as I can throw them. Even I can't find a problem with this. .05 is not drunk. Hell, .01 isn't drunk.
