I'm sorry , but you are incorrect. She abused her position as a professional. This is the same reason it is illegal for a teacher to have a relationship with a student, even if the student is of legal age and consents. When you are getting paid to uphold certain professional standards and you do not do so, it is morally and legally wrong.

Also, this is a typical double standard thing as well. If it was a Male counselor and a female patient, you would be crying RAPE.

"The Rape, Abuse & Incest National Network defines sexual assault as "unwanted sexual contact that stops short of rape or attempted rape."

"Assault" just makes me think of violence I guess. Then again, nowadays you can spit or fart on a dude and be charged with assault, so go figure.

From what I understand, in Texas at least, there may be a five year period of waiting before a psychiatric therapist can even have sex with a patient. Therapy is not a place for romance. This woman had no boundaries, or professional ethics. The law in Texas will be applied, because our state prosecutors always have a killboner to punish anyone in their courtrooms.

"A licensee may engage in sexual contact with a client if the contact begins more than five years after the end of the counseling relationship and the non-therapeutic relationship is consensual, not the result of exploitation by the licensee, and is not detrimental to the client." (source)

From reading the story it sounds more like the man had an affair then ended it. The couple said that he stopped going to counseling and was having sex with her I assume outside of the office. I do not see how she could have talked him into having sex with her with the wife present in their normal sessions. Even if she did talk to the husband alone at some point and convinced him to have sex with here as part of counseling why would he say that he stopped seeing her, but his wife continued? How would he think going out on dates would be part of counseling? Why wasn't there a discussion between the couple when this woman suggested seeing them separately or at some point the fact that the husband wasn't having sessions in the office?
