I doubt anyone made "millions of dollars" when there have been only 84 downloads of this app since 2010. But he does have a good case! I just hope CC doesn't get hosed by the fees that the infamous Willie Gary will charge.

I'd like to see how they ill fair when anybody with an IQ over 50 realizes HP/Palm did not actually create the "Chubby Checker" app, but only acts as a store.

I can't sue Target because the Huffy bike I bought there fell apart. I can't sue Kroger supermarkets because the Eggo waffles I bought were tainted.

There are also limits to liability. 84 downloads, and some of those might have been promotional copies.

HP/Palm's only responsibility would have been to take the app offline when served with a DMCA notice over the name.

Oh everyone already knows. It's about going after the deep pockets. It wouldn't surprise me if he was offered a settlement already along the lines of "all revenues from the sale of the app" (probably topping out at $420, since $5 is probably the upper limit of an app like that and $1 is more likely).

Depending on the terms of service in the Palm app store, and the app approval process, there might be some kind of liability there. Pretty unlikely, but possible. What's certain though is going after the maker of the app would be a waste of time and money.

You can sue the store. People do it all the time.

So some one hit wonder who stopped being relevant 50 years ago thinks he hold all rights to the term "Chubby" for all eternity. No way this hold up.
