Hey, a legislator who is clueless about how the internet works. Fancy that.

2013-02-11 04:55:34 PM
Libel and slander are prohibited speech because they are 1) lies or 2) misrepresentations that do harm to the reputation of people. However, making fun of people is humour, parody or satire, which is protected free speech. Also, if the offence came from the truth of the representation of a person rather than from its falsehood, this is also protected free speech. You can't libel or slander somebody with the truth. In some cases, it might suffice to believe that you were speaking the truth, although don't quote me on that in court as I might be wrong, bulb-head.

I think this politician is wrong. You CAN make fun of people. It's a free country, almost. Especially if you make fun of people in such an obvious way that no reasonable person would construe the fun as a solemn statement of fact.

For example, if this politician's head were put on the slim, athletic body of a well-hung black pron star or athlete, it would clearly be a non-factual representation, and thus could not be considered libel or slander. After all, it's good to be a slim, athletic, well-hung black person. It's good to be young, black and talented.

It's not good to be a fat-headed politician. Especially a fat-headed Republican. Fat-headed Democrats such as the chubby Barney Frank or the egregious, giant Irish-head-bearing, and lamentably deceased Edward Kennedy, sometimes show signs of having brains in their heads rather than just being big-boned. It is definitely OK to have a big giant head if it is a big juicy, brain-filled head. Take Conan O'Brien--please! (rim shot)

Anybody else's body would almost be certainly an improvement on this guy.

I suggest a My Little Pony body. I think you can go as far as putting this guy's head on Whozit, you know, Willard Scott. No, wait, that's a white guy. Who am I thinking of? Al Roker. Thanks, Google!

Yes, definitely, short of some grotesque abomination of God's handiwork, like Rush Limbaugh, you can put a man's head on most bodies and even a moderate, reasonable, non-ultra-partisan Republican, will realize you are joking, should such a creature ever be seen again. They are believed to be extinct in the wild and to exist only in private zoos and old folks homes.

Question for Zombies: Does this guy have a fat juicy brain in his head or is he just big-boned?

B A: "No one has a right to make fun of anyone. You have a right to speak, but no one has a right to disparage another person. It's not a First Amendment right," he said."
Bullshiat - You weren't disparagedyou were made fun of - It's called free speech for a reason!

For some reason I have a feeling that this was part of his agenda. Hmmm no one paid attention to my idea last year, but it's a damn good idea. How can I get people to side with me? *shopped image of self starts showing up online* See fellow politicians, this could happen to anyone at any time, we are even vulnerable to this attack!

Wow. Thanks for the heads up and the compliment.

I have just looked at your bio and would like to take this opportunity to make some lewd and inappropriate proposals to you.

Dude.

Dude?  I was hoping for a little more detailed response than that!  You have been on my favorites list since you made that 1 shot, 2 kills joke months ago.  Expectations are high here.  At least share with the rest of fark what  lewd and inappropriate proposals were made.

revjake: Here's the actual text of the bill - I don't think that (upon my admittedly non-lawyering read), it seems all that bad, mostly hinging on the interpretation of a "reasonable person" and "obscene."

http://www.legis.ga.gov/legislation/en-US/Display/20132014/HB/39

"reasonable person" and "obscene."

are subjective, and in this instance there is no room for the interpretation of such.

Georgia lawmakers seem to have very shake backgrounds in constitutional law.  your face plastered over a nude model is probably going to be considered satire.  Not good satire mind you, but for 1st amendment purposes that's satire.

FTA: The bill received no action last year, but Smith hopes this year will be different, perhaps because the picture targeting him illustrates how vulnerable all politicians are.

"Illustrates how vulnerable all politicians are", what?!? Politicians are above everyone else?

I'm not sure if this comes from the article writter, or if it comes from a statement the bill authors may have made, but the subtext of this thought pisses me off more than stupidity in the bill.

Any politician who alludes to a class of public officials and their having collective interests outside their constituents needs to feel a wrath many times more intense than the Internet is already going to deliver for this stupid bill.

Can we just get all of the people who are offended by stuff on the internet or worried about it corrupting their children and have them simply not use the internet?  The same thing should apply for those who are offended by tv, movies, music, video games, etc.  If you are worried about being offended by it or having your kids corrupted by it, simply don't use it.  You don't need to dictate to everyone else what they should or shouldn't like/do.  I know, it's a ridiculous notion, but these morality based proposals about multi-media drive me nuts.  Any sort of censorship board like the MPAA or ESRB should violate the first amendment in my opinion.

Provide folks with a global system nearly impossible to actually regulate. Develop and give away assorted technologies for digital manipulation. Allow others to post hacks for those more complex programs you need to pay for. Do the same with assorted programs which obscure a users trail and traces. Create free sites on which people may voice their opinions and post images or videos. Allow the creation of other sites which instruct anyone who wants to know how to hide their traces, build bombs, make home made guns and weapons and expose flaws in assorted security systems.

Wrap as much of it as possible under Free Speech, then stand back as the lawyers fight each other to find ways to both protect and attack it.

So, who'd have ever thought this creation would ever be abused and used in ways to harass others that had never been dreamed of before?

Now, nations scramble to try and regulate the nearly unregulatable.

It's kind of like those folks who live in valleys below a leaky dam. They knew it was there when they moved in yet they're always surprised when it breaks and wipes out everything.

There needs to be a law that expedites the removal of these retards from office. Obviously the voters who elect dipshiats like this are also too ignorant to make their own decisions.

If an upper management tool came up with the idea to seriously package and market pigeon poop, he would be gone that day. Yet we endure the ignorant and corrupt for as long as their term, and most times for more.

Luckily there are courts and federal laws.

I've had an idea for awhile now that anyone running for public office should have to score above average on an I.Q. test and also ace a test on the Constitution. That way, every candidate is actually suitable to hold office. It won't fix the conderpative/libtard divide, but at least they would be qualified to govern, and the voters' can still vote for whom they want. Any way they vote is a reasonable decision.
