Suddenly living in flyover country isn't so bad - especially when an overbearing DHS thug decides that the two coasts are also along the border & anyone within 100 miles of them is subject to the same rules.... who needs a 4th amendment then.

We've had a 4th Amendment-free zone for about 11 years. It's called America.

2013-02-09 08:11:05 PM
According to legal precedent, the Fourth Amendment - the right to be free from unreasonable searches and seizures - does not apply along the border

I'm curious about the legal logic behind this.

But I thought it went further back to the 80's related to the drug war.    Just have the dog bark on queue.

sno man: How's that whole "Land of the Free" thing working out lately?

"Land of the Free" would be Somalia.  The US has never really been truly free.  But we are sadly becoming less and less free because the people charged to protect us are too incompetent to do their jobs without forcing us to live in a police state.  You know, like how 9/11 might have been averted if the jackwads at the FBI didn't have such an engrained issue with fiefdoms between organized crime and domestic terrorism units.

Very interesting article I read the other day about how utterly worthless drug dogs are.  Often greater than 50% error rate, no certification and corrupt handlers.  I'd actually like to see their use either brought under much stricter scrutiny or just eliminate them altogether as a means to suggest probable cause.

Freedom comes with responsibility, freedom without responsibility is Somalia. Of course my question was a bit facetious... The freedom that America seems to celebrate is ether, that never really existed anywhere, the second half about responsibility is never mentioned as if everyone collectively forgot about responsibility...

ZOMGTERRORIZMS!!!1!

That's the logic behind the idea that the 4th Amendment doesn't apply at or near the border.

/while going through an actual border crossing/Customs, I can understand, since you technically aren't in the country yet
//but 100 miles past the border? That's a load of horsesh*t

Don't forget that you have to add all the international airports. Fly into there and they can search your laptop hard drive at that "border" as well.

How long will they claim that the 100 mile zone radiates from every airport?

/What will they do if you refuse to give them the password and have PGP?

Very true!

But be careful, you'll rile up the "both sides are bad, so vote republican" crowd of democrats who dominate the politics tab.

One thing I've learned on Fark over the past 10 years... democrats are inherently incapable of doing anything wrong. The more you know!

In the past, this has been applied to border crossings.  You aren't in the US and protected by the constitution until you've cleared customs.  Prior to that they can do whatever they want.  This hundred mile crap is crap.

Every religion is a cult.
It all depends on how popular the cult is for people to ignore that worshiping a sky fairy is batshiat insane.

/British Columbia and Canadas lack of new recruits to be police officers: It has led to the government wanting to use border guards and deputies(prisoner transfer officers) to do 'police work' like traffic tickets and stuff.
It would be illegal to do that under various laws that protect people from security guards overreach(same classification: border agents and deputies). Pervs of the TSA violate Canadian law every moment of the day and the police ignore that.
A security guard in Canada is not allowed to do what the police do. So no guns and no 'arresting' people and taking them to jail or raping them(unwarranted strip search).
Security guards are classified a regular citizens. aka: citizens arrest, but you can't cock block a perp to stop him from running away, unless he committed a actual crime.

I don't think anyone thought that, just that the alternative was worse. And how is Obama 10x worse than Bush? How many countries did Obama invade for no reason? Which of the two imposed the Patriot Act and Gitmo? I could go on but you know the list. Yes, I blame Bush.

My solution would be having security set up the way it was before 9/11 when everybody starting crapping their pants gave away their liberties.  There is no reason this country needs this constitutionally infringing extra security.

Something something gun grab, something not closing Gitmo, something Obamacare.  The only part of their argument that is valid, is that Obama's administration knows better than to do this crap because it had a great example in Bush.  The alternative is worse, but that's not an excuse or even a weighted argument.  Too bad we, as a country, don't go back to voting for the better candidate, not the lesser evil.

And if we can drop this habit of pissing ourselves in terror and jumping to self-soothing reactions, maybe we can get moving into the 21st century.

Precisely this.  Whenever I think a new law or regulation is a good idea, I always imagine how it might be abused by my worst nightmare of an administration.  Then it usually doesn't seem like such a good idea anymore.

I'm generally supportive of the ACLU, but in regards to that map, how does Green Bay to Chicago to Traverse City fit within the 100-mile border zone? Last time I checked, the Queen's Canadia had no territorial claims to Lake Michigan. Mapfail?

Which one has renewed and expanded the Patriot Act?
