As much as it pains me to defend Walmart, I tend to think a lot of negligence cases need to be thrown out under a clause that shiat happens. There are obviously cases where a company is clearly negligent, but slipping on a sign on the floor seems a whole lot more like shiat happening.

It appears it is something that males are susceptible to and you do not know that until after shoulder surgery and it happens.

So my GED in law tells me that that the jury decided this because if Wally World had kept their store hazard free he would not have fallen, gotten hurt and have this condition occur because of the surgery.

His attorney said she only asked for $600,000 in damages, but the jury awarded her client more than double that figure.

"We are very grateful for a jury system in this country that will allow a small local lawfirm like mine and an individual to be able to level the playing field and come in and have a fair trial against a large corporation like Walmart," attorney Gloria Seidule said.


Not to mention the extra $233,333.33 in fees.

Probably saw the sign on the floor and thought Kaching it's payday time.  Did his slip and fall routine and wound up hurting himself a whole lot more then he was planning on.

I don't think wally world has health insurance and considering the stitch job on him and lawyer expenses he probably only has a couple hundred grand at max which seems like a lot except there ain't no way he's going to be able to do any kind of work.

Actually yes. Swelling in the muscles in his arm caused the doctors to have to cut the muscles open to prevent them from exploding. Now they're malformed due to the swelling.

I thought they don't repair it if the person is old.. maybe its a young man. Also the $1M in damages doesn't seem that extreme seeing as the guy probably has permanent weakness in that arm-- its not significant weakness, and maybe it won't affect daily activities, but that arm will never really be 100%.
