Abby Hooper, 33, a married mother of three kids reportedly in October of 2012 had a sexual relationship with a 17 year-old student when she was age 32 at that time.

Where I live "aggravated" rape of a child means 10+ year age difference. If it's legitimate rape rape the charge is "with force" instead of "aggravated."

The age of consent in Tennessee is 18...but, you're allowed to marry at 16 (with parental approval).  And, if you're married, the age of consent magically drops to 16, if the sex is with a spouse.

Why not simply set the age of consent to be the same as marriageable age?

I get that a teacher shouldn't have sex with her student.  But, a charge of aggravated statutory rape seems extreme when they could have had sex perfectly legally had they been married.

Here in Maine we have to use charts & shiat.  A 14yo can sex up a 15yo, but not 16+.  After 16, there can't be more than 4 or 5 years difference, up to age 18.  13 and under is right out.  And even then, I think there's more in there.

If you consider that any teacher who is married to a student would almost certainly be discharged from his/her teaching duties, any sex a teacher has with a married student would almost certainly be sex with someone else's spouse.  So, the spousal exclusion against a statutory rape charge wouldn't apply and the teacher would be open to prosecution (for statutory rape and, even perhaps, for adultery).  That's my reading of the law, at least.

Any Tennesseans want to weigh in?

I don't really care one way or another where the age is set.  I just think the age of consent and the marriageable age should be identical.  If kids can marry at sixteen, they should have the right to have sex (outside of marriage) at sixteen.  If the State thinks people should wait till they're eighteen, then that should be the marriageable age -- whether the parents agree or not.

Frankly, the "age of consent" should only apply if the two parties have an age difference of more than, say, 3-4 years.

I lost my virginity at 15, with a 16 year old girl. That's pretty normal. Start asking people on the street when their first time is, you're going to get mid-teens as a dominant group. But technically, according to some US state laws, she raped me.

If it's based on age difference rather than absolute age then that solves a lot of problems. Adults still can't fark kids, teens who fark aren't wandering through a minefield of "is my significant other breaking the law?"

I've always liked the "Age divided by two, plus seven, or over 18" rule.  18 can fark a 16 year old.  22?  Has to be 18.  Is the older partner 14?  The other should be 14 as well.  13 and younger shouldn't be farking period, but if it comes up - something like a 13 year old screwing a 12 year old it should involve closed door discussions, lots of counseling, and possibly parents going to prison, but not the kids actually being brought up on charges.

Under this rule you have the benefit that once legal, always legal - in some states farking a 16 year old is legal as long as you're under 18.  If you're 18 or older, your partner has to be 18 as well.  So when the boyfriend has his 18th birthday suddenly farking his girlfriend is illegal when he may have legally been with her for over a year already*,

*Sexes are arbitrary.
