That doesn't mean a crime was not committed.
It doesn't mean that the criminal can not still be charged by responsible law enforcement.    Text messages are easily obtained with a court order.

The kids are lucky that all they ran up against is a bunch of Barney Fife pseudo-cops.

In middle school I was hanging out with friends and we split up cause I had to run to my house to pick something up with another friend while the others did some minor vandalism I guess while they were waiting. Another student overheard one of them make a reference to it at school while we were together so the cops show up one day and pull me out of class to ask me questions. I didn't say anything, he didn't say anything and nothing came of it. Was it stupid of him to do it and talk about it? Yes. But it is much stupider to talk to the cops about it.

Do you really think that a digital picture can't be pulled off of the phone or from the carrier?  They either had bad cops or they just didn't want to press charges and wanted the kids to learn a lesson on being stupid.

Almost all carriers keep a record of every photo you sent. Text messages are also easily found. All the victim has to do is put her records against his. It will show when she sent it & should also be able to show where the douchebag kid sent it when compared against her text documentation.

I think the problem is that a 13 year old girl who's willing to show you her girly parts is only rarely also a girl you hope to continue to have access to her girly parts. The good-looking ones know what they're worth, and keep it covered up. I suspect most of the exposure that occurs at that age is the exposee being bullied into exposing herself, or thinks it will somehow magically make the bullies like her and lay off. It's practically a trope that at some point the bullies are going to try and befriend the bullied in order to gull them into doing something awful.

I think I didn't communicate the story well enough.

I never said anything was wrong with the person who reported what they overheard.

I said it was dumb of an old middle school friend who I haven't seen in 10+ years to vandalize something and then go on to talk about it openly, but was smart enough to keep his mouth shut when it came time to talk to the cops because his confession would have been the only evidence they had.

And if you were interest the vandalism was breaking into and spray painting an abandoned building that should have been torn down years before and was torn down not that long after the incident, it isn't something I would condone today but it is hardly something the community at large would care about.

This. I read it as a case of common sense breaking out. Maybe it was school authorities, the cops, the parents, maybe all of them. There was nothing to be gained from prosecuting these kids. A good grounding, maybe detention, cellphone confiscation for a bit, mandatory time with the school councilor - you know, discipline before the world went "OMG A POCKETKNIFE, CALL THE COPS" stupid. The "crime" in reality is about as serious as catching a couple making out behind the bleachers (note, it is a serious offense calling for appropriate reactions, but from parents and educators interested in keeping that girl 'off the pole' not the police).

We need more of this in the world.

these 'sexting' persecutions bug me. i've read about too many people who have been arrested for having pictures of boobs on their phone. any cop who pursues criminal charges against someone for child porn related stuff when the stuff in question isn't actually child porn should be publicly shamed and then imprisoned. even being accused of possessing child pornography is public information and will appear on any background check, even if the media in question wasn't porn at all, and it will haunt the person for the rest of their life.

No crime was commited at all.  These are kids damn it.  To bring them up on cirminal charges for this would pure stupidity.  Just maybe these pseudo cops know this and are refusing to push the issue.

The worse thing that should happen to these kids is thier parents take thier phones away and ground them.  There is no criminal case here, and never should be.
