I remember receiving a check for $1 from AOL that was a result of the civil suit against them for bombarding our mail with CDs.

So if I give some lawyer credibility by adding numbers to the people in his class action law suit, so that he can become rich, I may get $10?

Yeah. No.

Ha, what say you now, Mr. I Don't Have A Facebook?

Yeah, I concur with you folks above. Ten dollars...meh.

So they're shutting down Facebook and everyone must go back to Myspace and Sarah Palin is now president.
Got it.

Hear hear! Lattes for me and my, well, two other friends. No, guys, order the small. Look it's either that or only one of you can get one and then you'll have to share....

Hey, that's $10 I didn't have before. I'll take it.

Can we opt out of the suit and instead force Zuckerberg and the lawyers into a Thunderdome-esque combat situation?

This.

I can say I look at these things through a new lens after reading Grisham's The Litigators.

If more than 2 million people sign up then individual payment drops below $4.99/person and Facebook will not make individual payments, but will instead pay out the $10 million settlement to a charity involved with children's use of social media.

2013-01-29 08:54:23 AM
Facebook fumbles around in loose change, comes up with $20M settlement

probably halved by attorneys' fees, costs, and so on

125M people are emailed with offer of up to $10 apiece

if even 10% of recipients bother with this, suggests payout of less than a buck each

at which point it probably is deemed impractical to pay out at all

and the money goes to the designated charities

ta da

/no hero tag for these lawyers?

2013-01-29 08:55:49 AM
If someone uses my name or likeness without my authorization I'll make it personal. There will be no need for lawyers on my side because the company will retract out of embarrassment and probably sue me for slander or libel.

2013-01-29 08:57:33 AM
So the going rate for your names, profile pictures, photographs, likenesses, and identities is worth up to $10?
That's pathetic.

2013-01-29 08:57:34 AM
>100 million users eligible
>$20 million settlement

Assuming that everyone eleigible gets paid, that's 20 cents per user. Before the lawyers get their cut of 1/3rd.

Yeah, I'm sure that stings a lot on Facebook's balance sheet.

I received an email long ago about a settlement against...Expedia, maybe, for something like $0.80. I like to think most people would be like "what is this bullshiat" and move on with their lives; however, I know some greedy arseholes immediately sent in to get that check.

That isn't how class action law suits work.

The lawyer already got his, considering they there is a $100 million payout to the class, he already got a check from Facebook for around $30-40 million.

The person who brought the original case also got paid, probably in the $5-10 million range. The leftovers are distributed to everyone in the class as defined NY the lawsuit and approved by the judge. If you are in the class and do not explicitly opt in to your money, you get nothing, you lose, good day, sir. If you are in the class and do not explicitly opt out if the settlement, you forfeit your right to sue Facebook on this issue and get nothing/lose/good day.

I hold out for those class action lawsuits involving pharmaceuticals.

So, if FB had come out right away and offered this as a program.... "We'll give you $10 for unlimited use of your FB name and photo in ads", would you have done it?

Because... you basically did.

It's not even that.

100 million victims (more, actually) guzinta 20 million bucks less than 20 cents/user.
This is just a signal to Facebook to keep on keepin' on and that penalties are just a minor toll on the information soopah highway.

I'm filing an objection to the settlement.  It won't do any good, but I figure if I don't then my opinion won't even be heard.  Might not be heard anyway, but it can't hurt.

2013-01-29 09:42:39 AM
I never received the notice giving me an opportunity to opt out and pursue my own claim? Isn't that legally required?

What does it take to start one of these class action lawsuits? Any of you FARK lawyers want a few good ideas for some? I've been throwing around a few for companies I used to work for. -large Fortune 500 companies.

I nominate a new Monopoly chance card:

You have won a handful of butt pennies from a class action lawsuit.

Maybe one of them will be a 1955 double die.
