EvilEgg: BumpInTheNight: So she walked in on some hanky-panky. She reported it, tried to make a huge deal out of it and wouldn't drop it even after everyone else acknowledged how trivial the incident was. I'd fire her harpy ass too.

Probably wasn't her first time being a PITA. People like this are just easily offended. I just mentioned to an admin that perhaps she might be happier elsewhere if everyone offended her here.

Lemme guess, you guys work at places where you wouldn't get fired for a getting a bj on the job? I'd report his dumbass too for not being professional and able to keep it in his pants on the job.

Clark, of Elmer, is suing Acme Markets Inc.

The possibilities with just that part alone are endless .

When you see another employee farking the manager, it's pretty fair to assume that in addition to two workers not being available to perform work-related tasks during that interval, there's an unequal power dynamic in place. Is she farking him to get a raise or promotion that another employee would be more likely to get in the absence of the sex? Is he putting pressure on her through positive or negative means to secure the sex? It's damn sure worth investigating, although TFA doesn't mention whether the initial complaint to HR was regarding the sexual incident or the hostility and harassment she alleges occurred toward her afterwards.

TFA DOES pretty clearly state that you can't legally fire or harass someone for reporting things in that state and that the lawsuit is about her getting fired and the environment being hostile, NOT about the manager getting some that night.

Trixie212: A more likely scenario is that she was a worthless employee who thought she could use the manager's BJ as leverage to continue being a worthless employee but instead, eventually got fired for being a worthless employee.

FTFA: "20-year employee Mary Lynn Clark"

Yeah, you nailed it. I'm sure in 20 years of her being a worthless employee, they couldn't fire her. They've been patiently waiting through her worthlessness for an event like this, so they could harass her in the hopes that she would quit. When that didn't work, they finally decided "hey, maybe we should fire her for her worthlessness." THAT'S the most likely scenario. Good job.

Why? If he does his job well, what is the problem? The fact that he broke a rule or because you weren't getting any?

Well, his employees were unable to find him because he had disappeared, so I'd have to say he wasn't doing his job well. And in the act of performing normal job duties - grabbing some aprons - they were subjected to something that made them uncomfortable, and beyond that is covered by sexual harassment law. And then afterwards she was harassed and subsequently fired for reporting it.

I'm sorry that you can't keep your dick in your pants for 8 hours a day, your life must be so difficult.

If you read the article, she claims he started harassing her immediately after she caught him with the deli clerk. Maybe she would have let the hanky-panky slide if the manager wasn't a dick about it.  Either way, it sounds like she has a pretty good legal case.
