Clark, of Elmer, is suing Acme Markets Inc.

The possibilities with just that part alone are endless .

The Roadrunner hired Elmer Fudd to put Acme out of business because he's sick of the Coyote buying all his shiat there?

So she walked in on some hanky-panky. She reported it, tried to make a huge deal out of it and wouldn't drop it even after everyone else acknowledged how trivial the incident was. I'd fire her harpy ass too.

Probably wasn't her first time being a PITA. People like this are just easily offended. I just mentioned to an admin that perhaps she might be happier elsewhere if everyone offended her here.

Lemme guess, you guys work at places where you wouldn't get fired for a getting a bj on the job? I'd report his dumbass too for not being professional and able to keep it in his pants on the job.

Between this and the Farkers defending female teachers who sleep with student, I assume you work at some farked up places. Your job isn't a hook up joint or a love motel. What is it about having a professional work environment are you people missing? What a horrible manager, he even couldn't take his activity off property.

Why? If he does his job well, what is the problem? The fact that he broke a rule or because you weren't getting any?

If you read the article, she claims he started harassing her immediately after she caught him with the deli clerk. Maybe she would have let the hanky-panky slide if the manager wasn't a dick about it.  Either way, it sounds like she has a pretty good legal case.

If he couldn't be found when he was needed because he was having sex on the job, then he WASN'T doing his job well.

DerAppie: The fact that he broke a rule or because you weren't getting any?

I daresay that says a lot more about you than about the person you were responding to.

I agree with this. Especially since she is claiming psychological damage and reimbursement for counseling after witnessing the incident. Talk about overreacting!

A more likely scenario is that she was a worthless employee who thought she could use the manager's BJ as leverage to continue being a worthless employee but instead, eventually got fired for being a worthless employee.

Well, his employees were unable to find him because he had disappeared, so I'd have to say he wasn't doing his job well. And in the act of performing normal job duties - grabbing some aprons - they were subjected to something that made them uncomfortable, and beyond that is covered by sexual harassment law. And then afterwards she was harassed and subsequently fired for reporting it.

I'm sorry that you can't keep your dick in your pants for 8 hours a day, your life must be so difficult.

Ah, the you're jealous because you're not getting any action argument. Grow up man. If you're the manager of anything, its your job to keep things professional and set an example for the people under you, regardless of how cliche that sounds. If you want to fark employees, do it on your own time, I don't care. Supermarkets are dirty enough without human body fluids all over the place.

What, exactly, is the average life-expectancy of a job for a 20-year old at Acme, anyway? Maybe she wins a wrongful termination suit, but the damages will probably be next to nothing.

FTFA: "20-year employee Mary Lynn Clark"

Yeah, you nailed it. I'm sure in 20 years of her being a worthless employee, they couldn't fire her. They've been patiently waiting through her worthlessness for an event like this, so they could harass her in the hopes that she would quit. When that didn't work, they finally decided "hey, maybe we should fire her for her worthlessness." THAT'S the most likely scenario. Good job.

How did I know it was Acme Markets when I read the Fark headline...?

It's the only place I've seen where they were willing to sacrifice numerous employees to protect a manager who was embezzling from the company.

/ran across 3+ employee couples getting their strange on (while working) during the course of the investigation

2013-01-27 11:59:14 AM
When you see another employee farking the manager, it's pretty fair to assume that in addition to two workers not being available to perform work-related tasks during that interval, there's an unequal power dynamic in place. Is she farking him to get a raise or promotion that another employee would be more likely to get in the absence of the sex? Is he putting pressure on her through positive or negative means to secure the sex? It's damn sure worth investigating, although TFA doesn't mention whether the initial complaint to HR was regarding the sexual incident or the hostility and harassment she alleges occurred toward her afterwards.

TFA DOES pretty clearly state that you can't legally fire or harass someone for reporting things in that state and that the lawsuit is about her getting fired and the environment being hostile, NOT about the manager getting some that night.

Longevity doesn't necessarily mean someone is a good employee. Some people ride that fine line between messing up badly enough to get fired and doing the bare minimum required. It's not always a quick process to "paper trail" someone out the door.

We have those who will receive disciplinary notices all the way up to Final Written Warnings and then behave until the notices start to fall off and then start the process all over again. If she was that great of an employee, I don't believe any company would've risked this type of legal action to fire her. Who's got time to rehire and retrain someone else to the level a 20 year employee would have (or should have) been at?

She and a coworker walked into the manager having sex with an underling. Soon after, manager started harassing her. She and the coworker went to HR and had a phone interview, no discipline was taken on the manager, but the woman, who worked there 20 years, was subjected to continued harrassment and ridicule in the five months before she was fired. Apparently, that kind of employment harrassment is against the law where she lives, and its HR's fault for not disciplining the manager and coworkers for it.

Had a waitress at a Big Boy restaurant I managed some years back. Her nickname was Hoover. One day, she and a male server disappeared during a busy time. I went looking for them. All I will say is I discovered the reason for the nickname.
