Important thing the headline doesn't mention: proceeds from sales of Coulton's song go to charity.

That said...Coulton really got screwed here.

True, he doesn't own the rights to "Baby Got Back", but Fox lifted EVERYTHING from his version - the instrumentation, the melody (which is completely different from the original), even things that anyone with half a brain would have changed like the duck quack he used as a censor or the part where Coulton put his own name into the song.

I'm not sure if he's got a case or not, because copyright law is kind of messy here, but I sure hope he does.

The RIAA sued the grandmothers and children for 100 grand for each song they downloaded, right? So Coulton should get the same amount for each time the Glee version of his song was downloaded.

Oh...wait...NewsCorp is a very rich Corporation American, which means they can steal whatever the hell they want to.

They didn't just lift. They took his physical recordings and edited them apparently.

Guys like Shepard Fairey got run over the coals for photoshopping an AP pic while Fox took his actual song and edited it and rereleased it. Our IP laws are so screwed up.

haha bro, way to talk smack about the guy that wrote that song that was on the really popular video game, plays a lot of nerd conventions and is featured heavily in record collections that are anime soundtrack and Weird Al-centric. The internet is gonna be soooo maaaaaaadddd.

Particularly damning is the way in which, if you put the two tracks together, one in left channel and one in right, the drums and each note on the banjo line up PERFECTLY, even when the vocals are off a tiny bit.

The issue of who owns what is one thing, but JUST DOING KARAOKE OVER THE COULTON'S RECORDING and MAKING A PROFIT on it is scummy and deserves a good lawsuiting.

Duck quack at 2:40 in and the Johnny C's in trouble are the best evidence they are using the karaoke version or the master tracks from JoCo Looks back. Sir Mix Alot hasn;t said anything but i know he has done the song on stage with JoCo before.

I disagree; after all the crazy dealt out by the RIAA over piracy, I really would like to see a major network like Fox get slammed over this - because if an mp3 is bad, then an entire production department selling something over a show and iTunes should equal BAJILLIONS in damages.

But realistically they're a big corporation and the rules won't apply to them, so I guess you're right.

Actually I completely agree. His cover is so gay it is no surprise Glee covered it. It sucked on the show and his rendition ruined a fun song.

Sadly all Fox has to do is pollute the potential jurors through Fox news and then remove all the jurors who they don't think watch fox news during jury selection. I can totally see them doing that.

I had a lengthy post insulting both Coulton and Fox, but after listening to both versions of the song, I hope they all get radiation poisoning and their skin sloughs off painfully in a futile attempt to drink water from a sippy cup.

I get it, the song sucks. Ok. But does that mean its ok for FOX to just start outright stealing every internet song artist's original tunes just because they have the same lyrics as another song?

So if FOX stole from Weird Al or Richard Cheese, would you care then?

And that's the thing. When you have a group push for an issue so very hard, it's incumbent to hold them to the rule.

Unless they did lift his audio directly, it doesn't seem like Fox stole anything. They presumably bought the rights to perform the song, it's just that the entity they needed to buy the rights from was the original copyright holder and not Jonathan Coulton. Why? Because of the terms of the agreement JoCo made with that same copyright holder when bargaining for the rights to produce a cover.

He bought the right to make and sell a cover, but not the rights to derivative works of the song, including derivatives of said cover.
