The brief blurb the Daily Fail presents makes it sound like the guy was basically raised in a cult which groomed him for what he did from an early age. I'm willing to bet based on that they put up some sort of mental defense, based on the fact the defense claimed he didn't have the capacity to understand it was wrong to do it.

In all fairness, the Daily Fail is about as accurate and informative as public restroom graffiti.


That's offensive to bathroom graffiti. CSB: Was at a bar in Tucson, saw a whole bunch of stuff written all over the walls but one caught my eye; "For a math tutor call (Random Number)." I was so intrigued, I went back, told my friend and we proceeded to call this number. Sure enough, went to some math tutoring service I had never heard of. Helped us calculate a tip on our tab.

As some of you have said, this is the Daily Fail and we're probably not getting the whole story.

Based on the article, though, I'd call bullshiat on his defense.
First off, ignorance of the law is no excuse. This opens the door for more guys to use the same defense.
Secondly, I have to doubt his ignorance when, even though he went to Islamic schools his whole life and lived in a closed community, he still lived most if not all his life in the UK, was internet savvy enough to find the girl on Facebook, exchanged texts, and met up with her at a motel rather than, say, going over and meeting her folks.
Thirdly, he used a rubber. If he was truly as naive as they say, I'd find hard to believe he'd even consider that

Now, I do kinda agree that since he didn't really FORCE her into it he probably shouldn't get jail time. Along with the probation, he should also have to go through some sort of base legal education if he really is that ignorant of the laws of the country he lives in.

Culpability is the issue here, based on the daily fail wording. If he was, literally and for lack of a more accurate word, brainwashed into not being able to differentiate that statutory rape is wrong or a crime, then there's an issue of justice actually being served by sending him to a prison versus mental treatment/counseling.

If the judge gave him a lenient sentence based on "ignorance of the law is okay", then the judge needs a cockpunch.

Some points that are being lost here:

1. Ignorance of the law is no excuse: Definitely. That said, the defendant in this case was convicted of statutory rape. His sentence was quite mild (9 mo. imprisonment, suspended for 2 years, plus 2 years probation), due to a variety of mitigating circumstances as seen by the judge. In any case, he was not acquitted of the crime because of his supposed ignorance of the law.

2. The judge was foolish: The judge stated that the defendant was "passive" and "lacking assertiveness" and basically said that the 13 year old girl wanted it. All that might be true, but the defendant clearly had some idea what he was doing - he booked a hotel room and went there with a condom. Clearly, the possibility of sexual intercourse was at least present in his mind. He was not just "seduced" on the spot.

3. Islamic law: Far from focusing on the blatantly false analogy of women as discarded lollipops, Islam places a high value on women and enjoins Muslims to treat them with respect and honor. If the defendant was supposedly educated in an Islamic school, then he should also know that the punishment for "zina" (pre-marital intercourse) for him would be 100 lashes, as it is viewed as a serious sin and a criminal offense. He clearly knew that what he did was wrong, and attempting to reduce his culpability because he was "seduced" by a child is unacceptable.

I hope the defendant does something stupid within the next two years so his suspended sentence kicks in.

They are two different things entirely. The entire argument here seems to be that because of his upbringing and the environment he was raised in, he has diminished responsibility, or a diminished mental state, when it came to the crime. Even though he did not know the law, he could not perceive that he was committing a crime in the first place. In addition, the judge didn't cut him loose, but gave him an adjusted sentence based on the facts of the crime at hand and the environment he came from.

Not knowing the law is not the same as "I do not have the ability to see myself harming someone else or feel remorse for doing so" One gets you a jail cell, the other (if actually successful) tend to get you thrown into a padded cell for the rest of your natural life.

What you do is talk to them and then ask her to go out for a drink. If she gets carded and gets through it's all good. If she is turned away you go in for a drink alone and when you leave she's gone, no harm no foul.
