I've heard of 25 year old single malt in a can, but never bourbon.

There was only a single store in my area that has ever sold beer in a white can with just the label "BEER" in bold black letters, but generic beer exists as well. I've never been bold enough to try it, so I have no idea if it tasts like PBR as well.

Shouldn't hillbilly taint wash -er- bourbon come in a rustic Mason jar as opposed to a fancy-shmancy can?

Unless he drove to the gas station with the intent of pounding a can of bourbon and taking a nap, he was drunk when he drove there too.

But yes, let's white knight people who operate dangerous machinery while inebriated.

He was reported for driving under the influence, exceeding the prescribed concentration of alcohol, driving unregistered and breaching his provisional licence conditions, which require a zero blood alcohol level.

This is against the law?

FTFY. In my local area, we recently had some young guy sitting in a local Walmart parking lot before they opened. He was still sitting there hours later when someone called the police because he was suspicious looking. He was apparently eating a pizza and listening to the radio. He was warned about trespassing, but a few hours later they found him still in the same place, and when confronted, telling officers he had nowhere else to go. Sad, but if he had a beer while sitting there, he would probably have gone to jail without every having started the engine. That would have been even more sad.

Why not impound the car for a year as well?!? HE won't be driving anywhere (wink, wink)!!

Yes, the law enforcement officers and our judicial system should be allowed to make such assumptions.

That and rum in a can are all over the farking place here in 'STRAYA MATE.

Also, Aussie's drink canned rum and coke like it's going out of style, which wouldn't be too bad except mostly it's bundaberg which is complete shiatehouse. It tastes like burnt piss, there is no other way to describe it. The entire situation is particularly sad because probably one of the best rums in the world actually comes from Australia - Inner Circle Black. but unfortunately most Australian rum drinkers are inbred bogans who are just as likely to drink paint thinner so they can get mad and beat up gays or smash cabbies.

/btw... hurrah for australia day long weekend.

FTA: A check of CCTV vision showed the man driving into the service station and stopping at the petrol pump.

When woken, he was breath tested and returned a reading of 0.239, almost five times the legal limit.

So the possibilities are: (a) A guy drove drunk to the gas station and passed out or (b) A guy drove to the gas station with the intent of hanging out next to the pump and drinking a can of bourbon then sleeping it off for the 12 hours or so it would take him to get back to sober. If you believe (b) I have some ocean front property for sale.

So you prefer your judicial system to work on assumptions, rather than evidence and proof? Interesting.

It works on "beyond a reasonable doubt". If you don't think CCTV and a BAC test qualify as "evidence", you probably would have fit right in on the OJ Jury.

Ignoring your penchant for ad hominem arguments, answer the question: is there evidence of the driver having an illegal BAC while operating a vehicle?

"Bourbon" is an international trademark IIRC, which implies it was made in the USA. Why do the bourbon makers hate the USA?

/can believe the driver had a BAC of .239 after drinking most of a 12 oz (?) can of straight bourbon
//.239 is "nearly 5 times the limit" in OZ? Ouch!

Yes, because all alternative explanations are absurdly unlikely.

The RTD/RTS market is much bigger in Australia for hard-alcohol based products than it is in the US. It's partly driven by US liquor laws that tax RTD/RTS drinks based on the base spirit they contain. So an RTS drink based on bourbon is taxed as if it were bourbon, where as a 'malt-based' beverage is taxed as if it were beer. In Australia, the liquor tax structure is much different and punitive at higher proof - so regular bottles of spirits are much more expensive.

That's not an ad hominem argument. If "you have pee on your hands" had stated that your conclusion was invalid simply because you were on the OJ jury, that would have been ad hominem. Instead, he believes you would have fit in on the jury because of your ridiculous conclusion, and states his reasoning as to why it is ridiculous.

Don't know about Australia but in the states the car does not have to be running for you to get a DUI. As long as you are in control of the car (and being asleep in the car with the keys in your pocket counts as being in control) then you can be charged with DUI. Pro-tip, if you're planning on sleeping off a night of drinking in your car hide the keys, if the cops can't find them then you're not in control = no DUI.
