What you are asking for is essentially political suicide.  Yeah, we need to have an open, mature conversation as a country/society on how to deal with this, but the problem with the way US politics works is that the second someone suggests lessening the laws or reevaluating the way we prosecute (like 18 year old having sexy pics of his 17 year old girlfriend), that person is labeled weak on crime, and it is bullshiat.

As pointed out above, while we do not know what exactly this guy had, and I suspect that it is more than just a single random photo of a almost 18 year old, the zero tolerance, catch all approach that many LEO and country prosecutors are using, is something that we need to discuss.

Also, pointed out above, he could have raped a person and gotten less time, again...this needs to be discussed.


An important point that I should have mentioned in my original post is that CP cases are frequently tried by federal courts, while rape cases are usually handled by state/local courts. When a CP case is tried under state/local laws, the sentence is usually much lighter than it would be if tried federally, and usually fits to scale with that state's sexual abuse sentences. For example, a person tried by a state-level court in (insert state name) for possession of CP might get a year in prison, while a kiddy diddler who rapes a child and is tried under that same state's court might get 5 years. The punishment reflects the crime, and everyone is happy.

However, with so many CP cases falling under federal jurisdiction (as do many internet crimes), and seeing them dole out 5 year minimum sentences for simple possession while the state/local courts hand out 4 year sentences for actual sexual abuse, it gives the impression that CP is somehow worse than actual rape in the eyes of the law. In reality, it's just a matter of which court gets ahold of the guy.

All this jurisdiction talk aside, on a human level, it's just not right to let that happen. Although I refuse to defend any of these sick bastards, I'm tired of seeing injustice when it comes to an actual child who has been abused, only for her rapist to get less time than some guy downloading shiat in his mom's basement (where's the justice in that?).

Hell, I'd be fine having CP sentences stay the same. Just give the actual child molesters life in prison, then at least it'll be set to scale.

Sadly, this is frequently true.

About 4 days ago, a guy in a city near where I live got sentenced to 9 years for possession of CP. No aggravating factors. Just downloading the shiat off FrostWire or whatever.

Yesterday in my city, a guy got released after serving 6 years for molesting 4 toddlers.

/the parents are understandably upset.

I think the drawing thing is actually under obscenity law, not child porn, which is a critical difference because the Miller Test is more arbitrary and subjective, while child porn is actually defined pretty narrowly and objectively (and "community standards" are irrelevant in a child porn case but central to an obscenity case). "Underage drawings" as obscenity is fairly recent law and the improbable constitutionally is untested because the Christopher Handley case ended in a guilty plea. I haven't heard of any other convictions on it.

I've always wondered, what if he had pictures of teenagers on his computer but they were fully clothed or not sexual in nature? Is that considered child pornography?

I would search myself, but I don't want to get flagged so near the date of my impending coup d'état.

OK, I am going to put this out there for some good Fark fodder at my own expense. When I was 14, my dad found pictures of other girls my age I had downloaded. Worst punishment I had ever received. I didn't think I was doing anything criminal or nasty at the time, however, I was not aware of the consequences he might face if an investigation over said images came his way.

I get his concern and the legality of it now, and obviously the pictures were deleted, but what would be everyone's opinions on someone that used that as their defense?
