Not quite. The guy who uploaded the video is the guy behind the camera, artist Matthias Fritsch, not the Technoviking. No one, except Fritsch and the Technoviking himself (and probably the blue haired girl) knows who the Technoviking is.

No. The person who FILMED the video has been making money. Technoviking got none of it. He is kind of pissed that someone else has been reaping profits using him without any consent from him whatsoever, nor any monetary reimbursement.

Isn't it the derivative works that are more the problem here? If you caught caught in public making a stupid face, immortalized online, then I took that image and started making "stupid face: the graphic novel" and other associated goods based on you?

All I know is every vastly muscular, shirtless AW I've ever seen in a crowd, and I worked a LOT in crowds at musical events, had a huge chip they were just waiting for somebody to knock off of their shoulder. I had always been under the impression that Technoviking's name was Matthias Fritsch, I had no idea that was the person who filmed him.

He'd do better for himself if he just asked for a cut of the take on the video. Attempting to ruin the photographer is sort of a dick move, imo.

Heheheh, yeah, I dunno. I essentially mixed over 3000 live shows and while I wasn't doing security, I've managed to be able to sort out the people who just weren't LEAVIN' until it was all bout them. And most of them look like this guy, only with a gut, a less inventive compliment of facial hair and a sh*tty band T-shirt. Maybe he's a prince, but I usually bet on the most likely circumstances.

I was doing security for la caravan olympia, which is a huge Mexican mariachi band from Mexico in Albq, NM, back in the 70's.
I was an Air Force SP, moonlighting to pay for the groceries my fat, Mormon wife ate (or stockpiled in the closet) and the state police give us the run down outside before the show. Open search, no pat downs at your security point. Put any glass containers in the barrels and any weapons, call us. If they have weed, fark it, the sooner they get in, sit down, and light up, and mellow out, the better.
So this concert had a tractor trailer full of coors selling inside, Cans only. And there was a lot of beer consumed. Good crowd. Very polite. At exit time, there was this huge, drunken Mexican, think Danny Trejo, only 7 foot 18, picking fights with anything in a uniform. I'm watching him beat down guys I know that are pretty good at martial arts from the balcony. I go down and I'm standing in and inch of beer and there is a wall of exit doors with riot bars on them behind me and I call him out. Hey Vato!. want some?
He wheels around and charged a few steps and stops, and laughs. I'm 5'10" and unarmed (posse commitatus, I can't carry but a stick) and I say Hey, we gotta take it outside. and about face and exit.
Outside are 20 state police lounging about and I say HEY! There is a mad Mexican coming out here to kill us all! and they scramble. He busts out and they jump him as he chases me to the parking lot. Im almost to my motorcycle when behind me he breaks free, and grabs a cops gun, and decides he's going to plunge the entire area into darkness. He fires at the transformer nearest to him and the power goes out...
at the hospital next door . Picture being on life support and the power goes out.
The cops shoot his ass deader than door nails, and I jump on the Honda and scoot ass out of there.
Next day the boss man asked me when I left. I told him 3AM and got OT out of it.
Where was I when all this went down?
Well, boss, I circled back in to take a piss since the bathrooms weren't clogged, and when I came out they told us to stick around and give statements. My wife's pissed I got in late.

There exists a version of the "copyright troll" out there whose business model involves scouring YouTube, etc and identifying possible infringing material. They then contact who they think to be the original "owner" or "producer" of the material and convince them that this is a really bad thing; but for a price (of course!) he'll do whatever he can to correct this intolerable injustice, from sending a takedown notice to Youtube, just plain harassing and right up to bringing a lucrative lawsuit against the supposed perpetrator.

It's just how things have developed. Enterprising individuals will always be keeping an eye out for a way to make a buck at others expense.

OK there's defamation/libel at some point...

But in general the original performance was public and there is no ownership other than to the medium used (film, video, data) and that can be sold/licensed (see AP example above) to to the hosting service as per TOS.

But the derivative work is fair use IMHO since the original source was posted without license or if it was, it might belong to the hosting service (if covered part of their TOS). i.e, what does YT do when a video from their services is reposted on LiveLeak?

As someone who has been used so someone can make a quick buck, I can relate to Technoviking's dilemma.

I was on leave from a deployment a few years ago, when I was approached by a woman in her early 20s. She told me she was an aspiring videographer, and I was perfect for her next "art project." Having been drinking a bit, and thinking she was quite cute, I agreed, asking her what I would need to do.

She brought me to her studio and told me that her project was to film the muscles on my back as I attempted to break the ropes that would be tied to my wrists. The artist is trying to do the right thing by actively 'scrubbing' his involvement with the project.He should add to that effort by giving those YT 'checks' over to TV as an additional gesture of decency.The artist isnt a gubby pig recording executive,hes just an artist who inadvertantly created an awesome video.
Technoviking should just pardon the guy and enjoy his fame....then go kill the Grendle and its mother.

I agree it was a dick move to launch a meme-ology (or whatever you want to call it) career off it and get royalties from it, yet refrain from cutting the Technoviking guy any portion of the proceeds. In one form or another, the law about needing the permission of the depicted persons to publish an image have existed in Germany since at least 1907.

Clearly there must be exemptions for instances like famous figures and people doing newsworthy things. I wonder if exceptions for the latter only apply to accredited press members. Perhaps a lawyer could argue he was offering himself for specific scrutiny by leading a public performance.

There's one for "figures of historical importance.
But from the bits I've read, that's judged on a case-by-case basis, depending on how "public"/important etc a person is and if what (s)he's doing at the time is of public interest (entertainment seems NOT to count as public interest).

That's probably why, in practice, there's also a difference between "public life" and "private life", e.g. you might be allowed to take and publish a picture of pole-vaulting-meme Allison Stokke during some competition, but not if you see her out with friends having a burger at McDonalds.
It might be different if it's some sports superstar or in the case of McDonalds, if the celeb in question is some public campaigner for healthy eating slamming McDonalds (that could probably be argued to be newsworthy with relation to the public campaign).
OTOH, publishing a picture simply for entertainment value isn't enough. The Duchess of Cambridge might be a person of historic/public interest, but a picture of her sunbathing topless on private property with a limited, but not unreasonable expectation of privacy has nothing to do with her as a public figure (as nice as her figure might be).

Or, as another example, a Google challenge:
Try to find a picture of the step-daughter chancellor Gerhard Schröder got when he married his 4th wife while still in office. Or of the late president Johannes Rau's son and two daughters - with a quick GIS I only found one of them at his funeral and another one from a reception in honor of Rau's 75th birthday - apparently he was already too ill to attend and the children filled in for their parents.

If famous people don't drag their children into the public part of their life (seems to be required for US politicians to whore out their families) or the children themselves do something that makes them persons of public interest (e.g. publish a book), they're protected - see private versus public life.
It's nobody's farking business what the chancellor's or president's children look like or what they're doing as long as they themselves don't turn the spotlights on.

Using a photo/video for commercial purposes, pretty much anyplace in the world, requires a model release. TechnoViking hasn't been used as such by the original videographer (at least the article doesn't mention any such use). I'm not familiar with German law, it looks as tho the videographer was no more than 10 feet in front of him, so he must have known that he was being videoed. In the US, that's implied consent.

When tabloids print photos of celebrities, the celebrity does not get paid, nor is his/her permission needed to print the photo. The photographer makes money, as does the tabloid. The same with any editorial photo in a newspaper.

The legal definition of "commercial use" is not what you think it is. See my post, above. Making money off of the video doesn't mean that its use is commercial.

I'm not familiar with German law, it looks as tho the videographer was no more than 10 feet in front of him, so he must have known that he was being videoed. In the US, that's implied consent.

That's nice (or rather not) for the US, but in Germany that implies jack shiat.

The legal definition of "commercial use" is not what you think it is. See my post, above. Making money off of the video doesn't mean that its use is commercial.

When tabloids print photos of celebrities, the celebrity does not get paid, nor is his/her permission needed to print the photo. The photographer makes money, as does the tabloid. The same with any editorial photo in a newspaper.


You don't know crap about european privacy laws.
