At least second-degree murder, I imagine.  I'm not sure if Texas uses the "felony murder" doctrine.  Well, hell, they probably do.  In any case, as the perpetrators of the crime that led to the property owner shooting at them, apparently with justification under Texas law, they cannot invoke self-defense.  Whether the law is a good one or not is a different debate.

I think the net of is that criminals are finding themselves in a very paranoid and gun totting America after the last year of mass murders. It's becoming very dangerous to be a criminal of any stripe. We've had a couple shootings here in Georgia from break ins just within the past couple weeks.

I just got my girlfriend armed as some douchebags downtown are purse snatching and it's just a matter of time before one of them gets an entire clip shot into them from a scared as hell woman. The important part of this is that criminals have backed us into a wall where we have to shoot and ask questions later. If someone breaks into my house I'm emptying a clip of .45 hyrdoshock into them and then calling the police. Just is what it is.. I can't risk the lives of my family because the guy -might- not be armed or the guy -might- just think the house is empty and wants a TV. I have to assume the worse and so I do and will.

We are in the cowboy country after all.. and I'm going full cowboy. In this case the guy kept shooting American History X style and the law in TX is that you can do that. I figure if you want to be a criminal TX might not be the best place to do it in. In fact if you want to be a criminal the US is probably not the best place to do it.

I was mugged last week. I'm very glad that I didn't have a gun, because I don't think the penalty for theft should be execution.

In Texas a speeding ticket is a criminal prosecution and you can have a jury trial. Most of the rest of the country has abolished defendants' rights in traffic cases.

Damn.  Louisiana a speeding ticket just a municipal or Parish citation and you can't face jail time.  For serious stuff like DUI, they send you to criminal court.  Now, if you skip out on court, that can get a warrant issued for your arrest, but failure to appear in court - any court - when you are under order to do so is an offense all its own.

Personally, I wouldn't want to shoot someone taking off in my car.  I don't keep anything particularly valuable in it, and I'd really hate to blow out the rear windshield or the front windshield and who wants all that blood all over the driver's side?  Sure, the seats are leather, but the floorboard is upholstered and you're not getting blood completely out of that.

That's something else I'd like to know.  I mean, it was damaged in the course of a covered loss, but was that damage due to the owner's own intentional act?  Or would they subject it to your deductible as though you had run off the road into a tree.

Well, that may have something to do with the fact that 10 miles away from me, one of your kind of people decided to walk into a church five years ago and start killing liberals and Democrats, which he freely admitted was his purpose.  I don't worry about Muslims, I worry about armed Christians coming to kill me, because it has actually happened here.  I worry because people like you have a history of trying to kill people like me for political opinions, and you think you should be allowed to own every single weapon in existence.  I worry because I have a legitimate reason to believe that one of you good Christians will come kill me one day, and I farking guarantee that they will be a proud NRA member.  It isn't farking hypothetical.  And before you point out that it's a church, I have in fact been in that church.

If you don't want to be shot - don't do anything that might lead someone else to think what you're doing is criminal. This includes: look like a minority, appear out of place, appear too confident, appear too suspicious, speak too loud, play your music too loud, wear suspicious clothing, or pull out your cell phone in a way that could be mistaken as a gun at a distance.

If you're in a place like Texas where everyone and their dog has at least 3 guns, don't go breaking into cars or houses or shiat. You know what could happen, and its a risk you could take.

Probably shouldn't have shot them breaking into his car, but if there's someone in my house who doesn't belong there at 3 am, I'm going to shoot first and ask questions later. You don't know what their intentions are and by the time the police get there it may be too late.
