Needs a cool tag for the police(or hero). Years ago they did that when the town I live is was small, but as it grew, they now just throw you in jail for public drunk, or drunk walking because it all about the money now.

Why do you imagine the cops care? They get a chance to take his mug shot, take his fingerprints, and leave him in jail for the weekend. And on Monday the judge looks at it and says, "WTF is this shiat? You can't arrest a guy for that.". And then everyone goes home.

It is "suspicion" because they're waiting for the chemists (or whomever) to examine the substance. I assume they had probable cause to believe the mushrooms were psilocybin, but a visual examination will not always be dispositive.

Some jurisdictions on "suspicion" for DUIs before a BAT or possession of other controlled substances or even sometimes more serious crimes.

I've seen this term used this way before.

I'm not a lawyer or a cop but I suspect the term is used because the crime hasn't been proven in a court of law yet.

Imagine you down a fifth of Maker's Mark and then go drive to the liquor store for some more. You get into an accident. You know you're drunk, the cops know you're drunk but you still get to have your day in court. Who knows, maybe it would be slander or libel for the cops to say you were arrested for drunk driving.


Meh - whatevers.

They have to arrest you before they prove what that green leafy matter is. Or powder, or whatever it is. It's not up to the cops to do a roadside chemical analysis.
